Legal dimensions of restoring virginity in the marriage

In societies where a girl's virginity at the time of her marriage is of great importance for various cultural reasons, girls who do not have a hymen for any reason, sometimes try to restore their virginity to escape the label of illicit relationships, possible violence, loss of social opportunities and similar cases. This action has different personal, social and legal dimensions. This article deals with the legal consequences of this action in the field of family relationships. The legal aspects of restoring virginity in marriage has aspects such as: "requirement of the guardian's permission in the marriage of a virgin", "cheating in the marriage contract" and "determination of marriage portion".The current research uses the analytical-descriptive method and is based on library research with the tool of collecting information and extracting data from legal sources and judicial opinions related to the issue based on the civil law and the Islamic penal code. The findings showed that the guardian's permission does not last in a virgin marriage, and the wife's lack of virginity does not generally lead to the right of termination unless virginity is a condition. Also, the effect of virginity restoration is different in the calculation of marriage portion before and after sex. Finally, the authors suggest: legal articles related to virginity restoration should be revised;The relevant institutions should have a special supervision over the surgery centers for the restoration of virginity; Social assistance and the prevention of the crime of custodial power should have effective trainings to inform the society about the legal dimensions of virginity restoration and remaining importance for virginity, and national educational and media institutions, with successful parenting training, should prevent the disconnection between girls and their parents, which itself is the basis for slipping into unconventional relationships and or the subsequent cover-ups, including fraudulent virginity restoration.
