Evaluation of the falsification of the status ruling and its reflection in the course of Istishab with emphasis on Mohaghegh Khorasani's point of view

There are various opinions about how to falsify religious rulings among the Usulis. Some have considered it to be exempt from compulsory rulings, and others have proposed the possibility of direct forgery by the Shariah. The diversity of views on this issue has also appeared in the course of Istihab in the rulings of the state. Because the mustahab must either be a shari'i fake or a subject with a shari'i effect. Therefore, based on the same difference that has arisen in the method of falsification of the rulings of the state, there is also a difference regarding the flow of Istihab in the rulings of the state. The purpose of this article is to examine the flow of Istihab in the state of affairs. This research, with the analytical descriptive method and with the library tool, found that it is necessary to give details between the types of status rulings in this issue. Therefore, in the rulings of the first category, which are the cause, condition, obstacle, and decisiveness for the duty, if Istihab is not eternal, it is current Istihab. And in the second part, which is a condition for the obligation to, they are forged by the follower, istishahab is valid, and in the third part, the rulings of the state, which are neither a condition for the principle of obligation nor a condition for the obligation to, were directly forged by the Shariah, without Doubt, istihab is in the current situation.
