The Study of Khums From the View points of Shiism and Sunnism

Abstract:
Khums is one of the absolutes of Islam whose necessity has been stipulated by the Holy Quran. The Holy Quran has defined and described the payment of khums as having faith in God. Hence, it will be clear that not only the belief [in paying khums], but also performing [paying] it will be one of the religion’s necessities and commands. Both Shia and Sunni have consensus of ideas on the wojoub [obligation] of paying khums for the case of warspoils. However, the school of Ahl-e Beit (a), considering the apparent words of the verse "khums" and also considering its terminology and common low, not only for the warspoils, but also for whatever in terminology and common low named benefit, recognize khums as an obligation, and to prove the case the Fariqayn’s narrations are claimed and reasoned. This is while the majority of Ahl-e Sunnah, have made khums obligatory only on the case of war booties, Although, Some of them believe that paying khums will be obligatory in the case of finding a treasure and as such.
