To Study the Theological Principle of Article 630 of Islamic Punishment Law

One of the subject of Article 630 of Islamic punishment law is related to an offence against the family reputation. A married woman according to this article in case commitsadultery, the husband is authorized to assassinate his wife immediately. This article is among those cases which is under the scrutiny of jurists.This research work has been carried out with the purpose of having reviewed the theological reasoning on which their ruling is based upon. Moreover relevant issues such as penal law, legitimate defenses, withdrawing people from evil or inviting people to doinggood are also discussed. Further theological studies show that theabove mentioned ruling is an exception which is in conflict with the general principle of theology. So if due to certain conditions it has been accepted as an Islamic penal law, the consequences haveto be considered and discussed.
