Children's Rights and Parents Responsibility on Their Upbringing

Abstract:
According to customary law, personal life can not be legally disturbed without one's consent. Apparently the concept of child's privacy is in conflict with parent's duty. The development of technology and the advancement of communication has led to the complexity of the situation.Parents have no control over their children to follow them closely or to watch their behavior. With regard to the comfort and primary benefit of children, the U.N. convention on the rights of the child has given priority to parents to raise their offspring. Therefore the way is legally paved to intervene in their personal lives. Considering the supremacy of Parents rights over the children's personal life, the Iranian law has its deficiencies. Regarding the above mentioned ambiguity and how the differences between parent's rights on children's upbringing and children's personal life can be legally distinguished, this paper attempts to present some legal solutions. By studying the Iranian laws and international documents, some suggestion have been made to remove any doubts about this controversial issue.
