Investigating the Rulings Devouted to Wagf in Islamic Jurisprudence and Law Based on Deductiom

Abstract:
This article studies the important jurisprudential rulings of “Wagf” (endowment) in jurisprudence based on reasoning and deduction provisions from the words of Ahlul-bayt A.S. - sentences that are very important and practical. Wagf refers to the imprisonment of property - namely prohibited from the owner seizing, and in some cases seizing ownership of others - and its benefits are made available in the direction that Wagif determines; so the reality of Wagf, is Habs. The most important jurisprudence rule about Wagf is: “Woguf depends on what their owners determine", and states that the use of Wagf must be followed according to the dedicated lines that Wagif has determined in composing the Wagf, and this rule has been described in the article. Of the important results of this study, the following can be stated: Moatat flowing in Wagf and its accuracy, absence of stipulation Qurbt in Wagf, and stipulation of Qabz with the permission of Wagif, and provisions and other important issues in this paper based on the rational jurisprudence by using about fourty main sources of jurisprudence and several narrative sources, and some legal opinions bave been indicated in important cases.
