The problem of the prior and posterior condition is one of the significant challenges in jurisprudence and its principles, for which various solutions have been proposed by scholars in the field of jurisprudence and its principles. A crucial problem in this matter is the temporal distinction between cause and effect in some jurisprudential judgments, which is logically impossible. The theory of subjective considerations (i’tibāriyāt) and the distinction between the objective and subjective matters is an innovative and recent idea that was explained by ‘Allāmah Ṭabāṭabā’ī and addresses and analyzes the subjective perceptions. This research, using the descriptive-analytical approach, aims to examine and analyze the problem of the prior and posterior condition from the perspective of the theory of subjective considerations. The result of this study suggests that the impossibility of distinguishing between cause and effect is related to real objective matters that need to be separated from subjective matters. In subjective matters, as long as there is no necessity for revocation, there is no problem with subjectivity. Therefore, fundamentally, there is no logical issue in the problem of the prior and posterior condition.

One of the issues which has been raised recently in the Muslim community and has led to the emergence of different theories is the relationship between ‘delineation and obligation’ or ‘science and value’. With regard to this، proposing hypothetical perceptions، Allameh Tabatabaee draws a distinction between ethical propositions and existential or true propositions. Therefore، he believes ‘what explicitly exists’ can influence the authenticity of ethical propositions. However، he doesn’t clarify how such propositions can be deduced. Mehdi Haeri Yazdi، on the other hand، holds that ethical propositions and true propositions are from the same ilk. He believes ‘does and don’ts’ of ethical propositions are a manifestation of necessity in which there is nothing but existence and emphasis. In addition to explicating the views of these two thinkers، the present article evaluates their thoughts and discloses their strengths and weaknesses.
