The objection of third party in provision of Criminal asked

There is no doubt that third party can oppose to issuance or to execution of criminal attachment. Nonetheless, related provisions are vague and disputable because there is no specific and complete legislation in Iranian law. In this article, third party opposition, on location of the execution attachment and after its termination, will be considered in different presumptions and with respect to invoked documents by third party. In this approach, there are two significant principles: 1) Pretension of third party is not generally abstacle for attachment of goods which are in possession of defendant unless it was accompanied by defendant’s confirmation or authentic acts.2) Possessions of third party can not prevent of attachment in common conditions.
