A Study of the Couple's Sexual Rights and Concerning Gaps (A Case Study:The Marriage-tie Dissolution and disadvantages of Permission)

The sexual disorders between a wife and a husband is the concern of most of the scholars in different scientific courses such as psychologists، lawyers،jurists،and physicians. According to the ssuggestions of authorities ten per cent of men are inflicted in sexual impotency and forty percent of women are involved and have problems in their matrimonial life and suffer from sexual disorders. The law system of Islam is concerened with sexual demands and disorders and makes great efforts to remove these problems. For example،Islam permits divorce as one of the solutions to handle these Problems in marital life. However،there are still some sensitive quests from the view points of law and jurisprudence. There is no specific written solution to the spouse sexual problems in policy-making aand in planning. It is evident that carelessness in this concern may have certain malignant consequences such as depression،stress،worry،agitation،and even male/female deviation. This paper is concerned with providing a suggestion for the solution to this problem which is a suitable legislation to clarify and remove the vagueness of the existing laws،and the removal of the lawful defects and disadvantages as well as necessary performance surety. Finally،the article proceeds to study this topic from the viewpoints of jurisprudential and lawful bottlenecks as well as explaining them by existing data study while offering certain solutions based upon applicable laws and principles.
