Jurisprudent Principals for Supervising Dangerous Offenders

Despite the importance of explaining philosophy and addressing jurisprudent principals of many legal and criminal issues in the expanding and accepting these issues in Iran legislation, usually little research has been done in this area, and even in Islamic jurisprudence less attention has been paid to express philosophical precepts of the provisions; in this vein, considering a comprehensive research on the jurisprudent principals of supervising and monitoring offenders has not been conducted and previous scattered studies addressed some instances of monitoring and initial prevention of delinquency. On the other hand, the understanding of the principles and objectives of monitoring and performance necessities by its reactors, that is, the family, society and government forces, particularly the police, have not been well established. This study is conducted to evaluate the jurisprudent principals of supervising dangerous offenders. The required data were collected and analyzed using library studies of interpretive, jurisprudence, law, criminology books and specialized journals.Findings and The research findings showed that the jurisprudent principals of supervising offenders are based on three foundations: 1) the family-centered monitoring and control; 2) the community-based monitoring and control; 3) the rule-based monitoring and control. Moreover, in jurisprudent principals, the evidence that indicates monitoring dangerous offenders in modern sense is very rare. However, in the field of monitoring offenders in general, legal evidence can be obtained from the principles of monitoring offenders that is not different from monitoring dangerous criminals in terms of performance and purposes.
