Separation of intent and consent based on jurisprudence and law
The intention and the consent are two fundamental stages in creating contract and unilateral contract. This paper attempts to answer this question whether temporary separation of intention and consent is possible or there are conditions. Jurisconsults and jurists have offered three theories for answering this question: 1. The religious and intellectual possibility of temporary separation between intent and consent (the separation theory). 2. The religious and intellectual impossibility of temporary separation between intent and consent based on referring intention to religious consent (the referring theory) 3. The intellectual impossibility of separation between intent and consent whether the consent be natural or intellectual (the intellectual Inseparability) This essay criticizes these three theories and eventually offers its noble theory based on the religious impossibility of temporary separation between intent and consent and intellectual possibility of separation between them.
