Abstract:
The internal coherence of any scientific discipline and its capacity to meet the needs it creates is based on the fact that whether the discipline in question enjoys what can be termed as “system” or not. As long as a scientific discipline based on a governing world-view does not enjoy a system, it neither can meet the needs nor can be identified as orderly and consistent components in a form of independent scientific knowledge. Rather, it will face conflicts and challenges in its internal mechanism. “Public law” as a specialized discipline which has its roots in the West enjoys coherent sources, foundations, principles, objectives (aims), identity, character and certain classification. However, it must be admitted that the systematic design of the public law within the large-scale legal and jurisprudential system of the Islamic republic of Iran is based on a revision and rethinking of the elements, concepts, fundamentals, resources of the public law and the elements corresponding to the basic norms governing the constitution of the Islamic republic of Iran in order to devise an independent, coherent and efficient branch of knowledge in line with the legal substructures in such a way that it can meet the needs of the Islamic Republic.
