The position of The Threshold of Non- International armed conflicts under the Additional Protocol II

Abstract:
The subject of the Threshold of Non-international armed conflict is the boundary of the internal disturbances and tensions, such as riots and both isolated and sporadic acts of violence, which are not in the capacity of non- international armed conflicts. This Term simultaneous with the formation of Common Article 3 of the four Geneva Conventions, entered to the literature of international law in 1949.
The direct relationship between this subject with the sovereign rights of states particularly exclusive jurisdiction of the national judicial authorities and accordingly its direct aspects to managing the conflicts and the encounter with the operations of anti-governmental armed forces, has always been one of the most controversial parts of different diplomatic conferences, including those held for creating common article 3, Article 8 of the Rome Statute and particularly additional Protocol II to above conventions which this article dealt with it.
