The Impact of Criminology Doctrines on General Criminal Law (The Section of Generalities of Criminal Act 1392)

The writers of Criminal Act of 1392 predicted some rules following the beliefs in criminology (victimology) and their significance in criminal regulation in order to administer criminal justice more effectively, to strengthen the position and the role of the victim in the process of criminal justice which can improve the victim's position as one of the main actors in criminal justice. Thus legislature protect and consider the victim, who is an active actor in the criminal process which is one of the main foundation of criminal event and criminal act from two aspects :first, considering the role of victim in the occurrence of crime through (article 38,section c),and second, through some cases such as prediction of restorative justice in order to legitimate compensation to the victim (section "c "article 40) ,elimination of punishment through delaying the punishment and run the semi-freedom system in order to protect the victim (articles40 &58),strengthen supporting victim through suspending the punishment (article 43,section g). Thus, considerable attention to victim could be useful in order to run justice and realize the principle of individualization of punishment. This paper considers the role of victim in the occurrence of crime (a) and the effects of supporting the victim (b) in Islamic Criminal Law Act (the Section of Generalities articles 1-216).
