Abstract:
The present article discusses the responsibilities of the air carriers regarding the arrival of the damage to the passenger and goods, or the delay in passenger flight and arrival of the goods. Issues about the regulations relate to these cases and the defenses that the air carrier can make in these cases will be analyzed in domestic and international flights. This article covers the analysis of the Warsaw and Montreal Convention, because it relates to international flights and domestic regulations related to the discussion of domestic flights. The basis of responsibility is the strict liability and the regulations of the Warsaw Convention can also be applied in domestic law, and the cases of exemptions in addition to force majeurem, is pass of time barred of lawsuit.
