Abstract:
Considering the fact that information technology has made significant changes in contracts as well as the entry of Iran into the world of electronic contracts and the lack of specification of e-commerce law on many issues of electronic contracts. Therefore, a research aimed at examining the effects and errors of errors in electronic contracts In Islamic jurisprudence, the Rulings and effects of such contracts and the implementation of this issue were carried out with the Imams and jurisprudence of Iran, as well as the examination of the vacancies in electronic contracts. According to the information and foundations of the research, it has been concluded that there are many gaps in the various fields of error and misconceptions in electronic contracts. In this paper, solutions have been developed to address these barriers and gaps. It is suggested that the legislator in this regard approves the law and the specific civil procedure for commerce and electronic contracts in accordance with international rules and in accordance with dynamic jurisprudence, including rules of jurisdiction, conflict resolution rules, and national arbitration.
