Key words: buying of the debt, discount, banking law. A reflection on the religiosity of “legal person”
“Legal person” is an accepted concept in law that its accuracy from perspective of Sharia is in dispute. Some of the Islamic scholars deny its existence in Sharia and hold it is free from Sharia conditions. Some others although accept that in the Islamic jurisprudence things other than real persons are also subject of canons and rights, they deny religiosity of the new forms of legal person. And finally some others claim that all forms of legal person are in accordance with Sharia. The authors although accept the last idea, do not believe that all of their arguments are able to prove their claims. The main cause of differences of the ideas on the issue may be the weakness of the reasons propounded. Reasons like lexical absoluteness of the reasons of sale, confirmation of the laws about legal person by the Guardian Council and the manner of the reasonable are not accepted as sufficient reasons by the authors of the paper. Only removal of exclusivity and the manner of the reasonable which is confirmed by the establisher of Sharia (Share’) are accepted as reasons.
