Apparent Conflict Solutions in Penal Principles (Intention and Practice) Based on Religious Texts

Abstract:

The punishment and its influencing factors are among the important issues that have been mentioned in various methods in religious texts. By examining a set of verses and narratives about the punishment, one can consider satisfaction and action as two influential elements in the punishment calculation of one's practice. This means that in Islamic teachings the punishment of the individual is sometimes evaluated on the basis of satisfaction and sometimes on the basis of performance. Hence, at first glance the reader notices the conflict. Therefore, in the present study, by using a descriptive-analytical method we try to provide some solutions to eliminate primitive conflicts and in this way, we come closer to the philosophy of convicted and satisfied punishment. The findings of the study indicate that by clarifying the concept of satisfaction, paying attention to the application of literary sciences, separating the field of ethics from jurisprudence, and distinguishing the fundamental principles from secondary principles of religion, one can resolve the conflict. Thus, both elements of satisfaction and action were found to be effective and consistent in the calculation of action sentences.
