The Typology of Real Estates in Civil and Registration Laws According to Imami Jurisprudence
The typology of the real estate properties based on civil and registration laws is the requirement of gaining cognition over these properties. Transferring physical real estate properties in their essence is a function of their locations, but to which one it’s possible to call a real estate property, needs redefining of the different types of real estate properties based on civil and registration laws and their adaptation to the Islamic jurisprudence. While explaining the concept of property, real estate, and ownership transference, we’ll be describing the indices of the real estate properties based on the basis of civil and registration laws. The importance of the real estate properties in registration laws comes from the 10th and 11th clauses of this law, in which it’s required that every real estate property be registered in any location. Also, in 46th and 47th clauses, it’s mandated that all contracts and transactions related to such properties have to be registered, and the normal documents in the hold of the owners of such properties, according to the 48th clause of this law, are unacceptable in official offices and courts. Facilitating library resources and receipts, we have the goal of identifying the differences of the real estate properties between the registration laws and civil laws according to the jurisprudence, and while redefining real estate properties, we show the continuity of these definitions.
