The Iranian Constitution and the principle of absurdity
The prosecutor as the main party of a public offence, acts on behalf of the society and presses the charge against the Adverse party- the accused. The prosecutor, according to the substance of his delegation holds all the necessary possibilities to prosecute and finally punish the accused and can issue the summons and warrant orders. But, the accused solely owns the benefit of the principle of innocence. Iranian Constitution has recognized this principle in its Article 37. Other Articles refer to it as well. In present paper, the concept, the basis and the effects of the principle of innocence and the quality of the protection of it in Iranian law, especially in Iranian constitution has been reviewed.
