Abstract:
Contract of Guarantee in Imamiyah Jurisprudence has in comparison to other legal systems and Sunni Jurisprudence a narrow scope in various regards. Such a narrow scope bring about some difficulties. But common and trade custom did not follow feqhi commitments and sometimes went their own ways. Jurisprudence theory could not disregard common developments and needs and thus submit to some these needs. This article tries to first enumerate different factors restricting the scope of Contract of Guarantee and then to study various solutions which proposed or could be proposed for extending its scope.
