Pathology of Ignorance in Transactions
Humans have different spirits, different attitudes, different wants and needs, and they are always looking to make their dreams come true. One of its practical methods is in the form of transactions, so when we look at the nature of transactions, it is observed that contracts and transactions have different purposes, some purposes are to make a profit such as selling, others benevolence such as borrowing. And in some transactions there is a background of arrogance and others are non-arrogance. With this approach, it is said that, in some contracts, the existence of knowledge is a necessary thing, and if there is no knowledge, arrogance will be realized, which will result in loss. And the loss and arrogance of the intellect and the sharia is negative and has effects, such as invalidity, termination or preparation of damage, etc., of course, in some contracts, the existence of knowledge is not necessary, such as borrowing. Because the nature of that contract is flexible against ignorance, arrogance and loss. If it is not science or it is not detailed science, it will not harm the transaction. In this article, the subject of science in transactions (in a special sense) examines the views and opinions of Imami jurists and uses the views of Iranian jurists and experts along with the jurists, and at the end, the author's opinion is expressed by presenting the result.
