Sanction as Force Majeure with Emphasis on the Analysis of Judicial Precedent
Can sanctions be considered as force majeure? In answer to this question, there is difference of opinion in the judicial precedent. The answer to this question seems to depend on the predictability or unpredictability of sanctions.Due to the occurrence of sanctions from the beginning of the Islamic Revolution, some courts consider it as a predictable phenomenon and, as a result, hesitate to consider it as force majeure.However, another group of courts believe otherwise. They hold the view that its acceptance as force majeure is justified considering the fact that "increase in the scope of sanctions" and "their return" is reasonably unpredictable.
