Legal Structure, Laws and Regulations about Right on Business: Pathological Study
Today, the people of the world are facing complex and multidimensional economic challenges in such a way that at the international, regional and national levels, the human population of countries is facing abysmal livelihood impasses. Regardless of the economic, social and political aspects of this issue, it seems necessary to study and pathology of the legal structure of the Right to Work, as one of the fundamental and citizenship rights, recognized in most legal systems, including the legal system of the Islamic Republic of Iran, in order to improve the living conditions, enforce the mentioned rights and ensure economic security. In the Constitution of the Islamic Republic of Iran, the general policies of the system and other upstream documents on the subject of the Right to Work have been repeatedly and emphatically identified and the general principles and main foundations of its legal structure have been mentioned. In addition to the constitutional norms and documents mentioned, the formal and substantive approach of the current laws and provisions on the Right to Work is studied and the main disadvantages of the existing legal structure such as ambiguity and conciseness, conflict and parallelism, obstacles to resignation, lack of enforcement guarantees and the negative approach of laws and provisions are addressed. Therefore, the main question of this research will be answered: “What are the disadvantages of the existing legal structure of the Right to Work in the laws and provisions of the Islamic Republic of Iran?”
