Crimes Based on Concealment with Emphasis on Child Concealment

Abstract:
In this research, the crime of hiding a child is explained and researched based on Iran's criminal policy towards hiding crimes and secrecy. Concealment is defined in criminal law terms as the concealment of a person, property, or the actual nature of property for a criminal purpose. Hiding is not a crime in itself; but sometimes it is a matter of concealing an act that endangers public order and the legislature, to prevent it, criminalizes this act and determines the punishment for it. A special law has been passed regarding the abduction of a (newborn) baby only in some legal systems, including Iran. Therefore, in this passage, the constituent elements of the crime of hiding a child from a jurisprudential and legal perspective are examined.In terms of meaningful content, in conclusion, he stated that the famous jurists believe in abducting a child on condition that he does not sell it, but if the thief sells the child, according to the majority, his punishment is amputation; The law also prohibits the abduction and hiding of children and provides for imprisonment as well as fines. The law also provides for imprisonment for this case.
