Abstract:

Waive of right is an important topic that is given special attention in various jurisprudential and legal issues,law scholars consider the goal of providing legal rules as providing human freedom and respect for the personality and the rights of individual.As human being has the right to freely develop his spritual and material activities :he has the freedom to deprive himself of same rights. Free will in deprivation of right is one of the important issues of legal Freedom.So that the lack of it makes human life difficult and impossible.Principle of waive right in Iranian Iow and Egypt has similarities and differences.Egyptian law has paid special attention to customand natural rights and Justice.The virtue of custom in the sunni view has added to its importance in Egyptian law. While in Iranian law regard 0less of non attribution to the fundamentals of natural rights and Justice considering the official religon of the country ,the custom does not have the same importance in this 1318 civil law.
