Separation of combatants and non-combatants in war with emphasis on humanitarian rights in Islam

Abstract:

Since the history of human life has always been associated with wars and conflicts, both domestic and international, and during the wars there have been many killings, many of which were unjust, in this study we seek to protect the rights of non-combatants. Examine the fighters during the conflict from the perspective of Islamic humanitarian law. Given the Islamic approach to respecting the rights of non-combatants and the distinction between them and combatants, it is important to distinguish between the two. Because the principles of humanitarian law have a long history in Islamic law, before being formulated in international instruments such as the Hague and Geneva Conventions of 1949. This issue can be seen in the verses of the Holy Quran and the biography of the Holy Prophet (PBUH) and the pure Imams. Studies show the importance of the rights of all human beings, including combatants and non-combatants, and the inherent dignity of individuals from the perspective of Islam
