Abstract:
Background and Aim
Proceedings, whether business or civil, consist of two parts: the principles and formalities of the proceedings, the formalities can be extracted from the text of the laws and it must be acknowledged that one of the bodies of the proceedings are these formalities, and compliance with these formalities is inevitable and mandatory. On the other hand, principles are distinct and separate from rituals and have general, permanent, abstract and valuable characteristics.
Materials and Methods
The current research is of a theoretical type and is descriptive and analytical; Also, the collection of information is library-based and has been done by referring to documents, books and articles.
Findings
The principles of civil procedure are initially designed to rule on lawsuits under normal conditions (no need to support one side of the lawsuit); While in the space of labor rights, the principle of protecting the worker prevails. The principle of equality is the cornerstone of the principles of civil proceedings; While this principle has been adjusted a lot in the atmosphere of worker-employer relations.
Conclusion
The principles of procedure are the foundations that are considered binding in the legal system. Although there is a set of fundamental principles in civil procedure, if they are not followed, the procedure will not be fair, But sometimes, due to the special principles mentioned in the introduction of the labor procedure, the fundamental principles of fair proceedings are overshadowed and not observed as they should be.
