Abstract:

Freedom of expression is one of the fundamental human rights. Freedom of expression is one of the prerequisites for the realization of a democratic society, but has become a disputed right because it may conflict with other rights. It cannot be regarded as an absolute right, so restrictions such as national security, public order, public interest, the protection of the reputation and dignity of others have been enforced. This paper deals with a descriptive-analytic approach within the framework of the norms, structures and institutions of public law and the analysis of restrictions on the right to freedom of expression within the American Convention of Human Rights. Our question in this research is, the right to freedom of expression is an absolute right? In response to the limitation of this right, in addition to observing public interest considerations, human rights standards may apply.
