Investigation of the silence of law about reviving after execution from lawyers and jurists perspective
Drug addiction as a social scourge, is an ominous and destructive phenomenon. All human societies and most governments are agreed in this issue that drugs and its related crimes have threatened the human race. Therefore it is believed that solving this social problem requires continuous struggles in the aspects of military, social, and cultural. In our country, by performing severe punishments like execution, and long term prison are considered as criminal prevention methods against the drug crimes. The aim of this study is the investigation of lawyers and jurists opinions regarding the re-punishment of revived criminals after their execution. In order to determine the capital punishment for the crime of drug dealers and for its legal justification there are only three possible ways and sources viz. Corruption Supply on earth, Sharia Punishment, and Rule by Decree . By investigating the legal texts and legal evidences it is found that determining the sentence of death penalty for drug addicts based on the sources of Sharia Punishment and Corruption Supply on Earth is not justifiable and it is not compatible with Islamic Principals. Therefore, there is one source left here which is rule by decree. The guardian can sentence the execution in order for protecting the religion and Islamic system.
