Abstract:

This article features the treatise Faskh al-Ba’i, written by Lotfullah Maissi Aameli Esfahani, an 11th-century scholar from Isfahan (d. 1032 AH), in Arabic. The author begins with Maissi Aameli’s biography, discussing Sheikh Baha’i’s authorization granted to him in 1020 AH and the views of scholars from the 12th to the 14th century regarding his work. Subsequently, dozens of his books and treatises, primarily focused on Shia jurisprudence, are listed. Following this, the article delves into the introduction of the treatise Faskh al- Ba’i, which specifically addresses transactions. The perspective is approached from the standpoint of bibliography and codicology, and subsequently, the text of the treatise is examined. Furthermore, the article includes quotes from Mulla Abdullah Shushtari’s book Jami’ al-Fawa’id fi Sharh al-Maqasid, where his opinions on this issue are presented
