A Critique of the Inclination towards Quantification in the Anti-Narcotics Law Based on Quranic Teachings

Abstract:
investigating the conditions for the realization of " Mufsid fī al-Arz[1](corruption on earth)" based on Quranic verses has a significant impact on criminal law and the preservation of the social system. In the verses related to "corruption on earth" and Article 286 of the Penal Code, qualitative conditions such as prevalence, continuity, habituation to the act of commission, and causing significant harm to the physical integrity of individuals in society—essentially, the extensive impact of the criminal act on individuals and society—are introduced as fundamental elements of identifying an act as  corruption. While the legislator in the anti-narcotics law considers the quantity of discovered drugs as one of the conditions for establishing corruption, thus attempting to interpret and clarify the qualitative limitations mentioned. This paper, using a descriptive-analytical method and referring to library sources and deducing from Quranic verses, concludes that the criteria for establishing "corruption on earth" are qualitative, and the sole reliance on quantitative features of an act in the anti-narcotics law is incompatible with Islamic teachings.
