    تصویب قانون منع استفاده از نشانه های مذهبی در اماکن عمومی در 15 مارس 2004م. در کشور فرانسه حرکتی است که زمینه تصویب قوانین مشابه خویش را در سایر کشورهای اروپایی فراهم نمود. سوال مطرح در این نوشتار آن است که آیا امکان جمع این تقنین با سایر قوانین و اصول حاکم بر نظام سیاسی فرانسه وجود دارد؟
    به نظر می رسد پاسخ به این سوال از سه جهت منفی است که از تحلیل انتقادی گزاره های ذیل به دست میآید. جهت اول، بررسی نسبت این قانون با قوانین داخلی فرانسه همچون اعلامیه حقوق بشر و شهروند 26 اوت 1789 و قانون اساسی مصوب 1946 و 1958م. این کشور از یکسو و مقررات تعهدآور بین المللی فرانسه از سوی دیگر است که در برخی از آنها همچون اعلامیه حقوق بشر 1948م. ، فرانسه جزء کشورهای موثر بوده است. جهت دوم، اصول بنیادین نظام سیاسی فرانسه یعنی دموکراسی و لائیسیته است که آموزه ها و عناصر اصلی آن مثل آزادی عقیده و عدم تاثیر آن در مواضع سیاسی و اجتماعی، به راحتی قابل جمع با این قانون نیست و منهیات مندرج در این قانون با اصول پیش گفته در تنافی می باشد. جهت سوم، حقوق بشر به معنای عام و فراتر از قوانین و مقررات است که با این قانون مورد محدودیت قرار گرفته است و در مجموع به نظر می رسد ریشه این قانون و رفتارهای مشابه آن چیزی جز پدیده موسوم به اسلام هراسی نیست.

    حقوق حاکم بر تجارت جهانی، برخی ملزوماتی را باخود به همراه دارد که حقوق جهانی بشر، خلاف آن را از دولت ها انتظار دارد. بررسی و تحلیل نوع تکالیفی که این دو نظام بر مکلفان خود حمل می نمایند، نشان دهنده تناقضی است که در موارد بسیاری، در متن تعهدات تجارت جهانی از یک سو و حقوق جهانی بشر از سوی دیگر، نهفته است. هنجارسازی های این دو پارادایم؛ که اتفاقا هر دو متصف به جهانی بودن هم هستند، یک متعهد به نام دولت دارد. پرپیداست که در اغلب موارد دولت ها ناگزیر از زیرپا گذاشتن یک قسم از تعهدات خود در موارد برخورد و تعارض تعهدات و الزامات خواهند بود. نوشتار حاضر با عطف توجه به این تناقض و توضیح مبسوط آن، به ارائه راهکارهایی برای رفع تناقض پرداخته است که در ضمن آن، اعمال حقوق تجارت جهانی، دستاویزی برای زیرپا نهادن حقوق شناخته شده بشری نخواهد گردید.

    مقاله حاضر دربرگیرنده بررسی تطبیقی رویکرد اسلامی و رویکرد غربی به حقوق بشر بوده و جهت گیری کلی این بررسی را متمرکز بر دو موضوع جهان شمولی یا نسبیگرایی حقوق بشر مینماید. سوال اساسی در این مقاله عبارت از آن است که مواضع حقوق بشر اسلامی و حقوق بشر غربی در خصوص رهیافتهای جهان شمولی و نسبیگرایی حقوق بشر چه تفاوتهایی دارند. در مقام پاسخ به این سوال میتوان اذعان داشت که رویکرد حقوق بشر غربی مدعی جهان شمولی این حقوق بوده و به فرامکانی و فرازمانی بودن آنها صرف نظر از تنوع فرهنگها، قومیتها و مذاهب مختلف معتقد است و از اینرو حقوق بشر خودیافته را قابل تعمیم به دیگر نقاط جهان میانگارد. رویکرد حقوق بشر اسلامی نیز با تاکید بر فطرت خداگونه انسان که وجه اشتراک همگی ابناء بشر است، به جهان شمولی حقوق بشر و فرازمانی و فرامکانی بودن آنها باور دارد؛ با این وجود رویه دولتهای اسلامی در مواجهه با رویکرد تحمیلی غرب در حوزه حقوق بشر، متمایل به نسبیگرایی است تا از این طریق از اجرای حقوق پردازششده در جوامع غربی بگریزد. مقاله پیشرو ضمن تایید فرضیه به این نتیجه میانجامد که تفاوت موجود میان رویکرد و رویه دولتهای اسلامی در خصوص موضوع از آن حیث که اولی جنبه غیرپدیدارشناسانه و دومی جنبه پدیدارشناسانه دارد، قابل توجیه است. مضافا آن که موضع روشنفکری دینی را در خصوص موضوع به نقد مینشیند.

    از آنجا که وصف «جهانشمولی» یکی از مهمترین اوصاف «حقوق بشر» در عصر حاضر دانسته شده، تلاشهای گسترده ای از سوی نظریه پردازان برای تحلیل مبانی جهانشمولی حقوق بشر صورت گرفته است. نظریات اخلاقی به عنوان راه حلی فراحقوقی یکی از مهمترین مسیرها برای نیل به این مقصود بوده به نحوی که اخلاقی دانستن هنجارهای «حقوق بشر» تاکنون بزرگترین دلیل برای اثبات جهانشمولی حقوق بشر بوده است. بررسی نظریات اخلاقی که ظرفیت ارائه هنجارهای جهانشمول دارند، نشان می دهد که ادعاهای مطرح شده در این زمینه قرین واقعیت نیست؛ حتی نظریه اخلاقی کانت که قواعد اخلاقی «جهانشمول» و «انسان مدار» ارائه می کند، علاوه بر آنکه بخش بسیار مهمی از ابعاد حقوق بشر را تحت پوشش قرار نمی دهد، با ایرادات نظری فراوانی روبرو است. روش این پژوهش تحلیلی است.

    شورای امنیت ملل متحد به عنوان مسئول اصلی حفظ صلح و امنیت، از اختیارات گسترده و ویژه ای در راستای نیل به اهداف پیش بینیشده در منشور ملل متحد برخوردار است. از آنجا که تشریک مساعی در راستای رعایت و ترویج حقوق بشر در شمار اهداف و برنامه های ملل متحد به شمار آمده است، شورای امنیت به عنوان یکی از ارکان ملل متحد ملزم به رعایت آن است. از سوی دیگر، بسیاری از قواعد حقوق بشر جزء حقوق بین الملل عام بوده که تمامی تابعان حقوق بین الملل را متعهد ساخته و نقض آنها موجب مسئولیت بین المللی خواهد شد. با این حال، در رویه شورای امنیت با تصمیماتی روبرو هستیم که ناسازگاری عملی آنها با موازین حقوق بشری قویا در اذهان تداعی می شود. اقدامات قهری شورای امنیت که مستقیم یا غیرمستقیم باعث مرگ می شوند در مغایرت با حق حیات بوده و بسیاری دیگر از حقوق بشری مانند حق بر تامین سلامت، آموزش و اشتغال نیز در اثر قطعنامه های تحریمی می توانند نقض شوند. چنین اقداماتی بی تردید بر اساس حقوق بشر و بشردوستانه بین المللی غیرقانونی بوده و موجب مسئولیت آن سازمان خواهد بود.
    این مقاله با روشی توصیفی-تحلیلی در پی ارزیابی مسئولیت شورای امنیت ملل متحد در قبال موازین حقوق بشر و چالش های عملی است که این نهاد با گفتمان حقوق بشر دارد.

    چنانچه حقوق بشر بین المللی در قاب تصویری نقش بندد ظاهر ناموزونی ارائه می شود که عدم تناسب وجهه برجسته سیاسی آن بر دیگر اجزای نهیفش، تصویر کاریکاتور رنجوری را نمایان خواهد ساخت. این درحالیست که سنگ بنای حقوق بشر معاصر بر اساس رفع نابرابری ها و آلام اجتماعی-اقتصادی گستردهای شکل گرفته که درپی جنگهای جهانی و تعارضات بین المللی پس از آن به یک معضل پایدار بین المللی مبدل شده است. بنابراین سوال اصلی این پژوهش عبارت از این است که: «هنجارهای حقوق بشری چه نقشی در رفع نابرابری های اجتماعی-اقتصادی دارند؟»
    در این پژوهش و با رویکردی فرهنگی در چارچوب نظریه مکتب انتقادی که از دو ویژگی مهم؛ یعنی تبیین ناکارآمدی «وضعیت موجود» با هدف دستیابی به «وضعیت مطلوب» و همچنین اهتمام آن به مقولات بیناذهنی نظیر فرهنگ، هنجارها و فهم مشترک بهره میبرد، تلاش شده است تا این جنبه از حقوق بشر بررسی شود. در پایان نیز ضمن بیان چالش های موجود، راهکارهایی در جهت طراحی ساختارهای نوین بین المللی که در برگیرنده مفاهیم وگفتمانی جدید میباشد، پیشنهاد خواهد شد.

    The adoption of the French Law Banning Religious Symbols in Public Schools in 15 March of 2004 is a movement provided the passing of the similar laws in other European countries. The main question of this article is whether it is possible to aggregate this legislation with the other rules and principles governing the French political system? It seems the answer to this question is negative from three aspects obtained by the critical analysis of the following statements. The first aspect is the comparison of this legislation with the other internal laws of France like the Declaration of Rights of Man and Citizen in 26 Aug of 1789 and The Constitutions of 1946 and 1958 in one hand, and the international binding regulations of France on the other hand in which this country has been as the effective countries in some of them like the Human Rights Declaration in 1948. The second aspect is the fundamental principles of the French political system namely the democracy and laicité which their doctrines and main elements such as freedom of belief and its ineffectiveness in political and social dispositions aren’t simply aggregated with this law. The third aspect is human rights in the general sense and beyond the laws and regulations which are restricted by this law. On the whole, it seems that the root of this law and similar behaviors are nothing but a phenomenon known as Islamophobia.

    The ruling law on universal trade is associated with some requirements in which the universal human rights expects the states to act on the contrary. The analysis of the duties imposed by these two systems indicates an inconsistency which in many cases is buried in the world trade commitments and in the universal human rights. The normalizations of these two paradigms which incidentally are both qualified to the universe have one engaged called as the state. It’s obvious that the states in most of the instances are obliged to ignore some parts of their commitments in case of contradiction of the commitments and obligations. This article focusing on this contradiction and its detailed explanation provides some solutions by which applying the universal trade law wouldn’t be assumed as a pretext to abuse the recognized human rights.

    The present article includes a comparative study of Islamic approach and western approach about human rights and the general orientation of this review concentrates on Universality and Relativism of human rights. The main question of this article is that what differences exist between Islamic human rights and Western human rights in respect of universality and relativism of human rights. Answering to this question, it should be noted that western approach on human rights claiming universality of this rights and it believes that these rights are ultra-spot and timeless, in spite of the diversity of cultures, ethnicity and religions and thus suppose its innovative human rights extensible elsewhere in the world. Islamic approach on human rights emphasizing Human Nature as a common unity of all humans, believes too in universal ultra-spot and timeless human rights; Nevertheless the practice of Islamic States, in contrast with the imposed western approach, willing to relativism, in order to escape from executing that law. The present article confirming the hypothesis concludes that the difference between approach and practice of Islamic states in this respect is reasonable; because the first is non phenomenological and the second is phenomenological. In adition it criticizes the position of religious intellectualism about the matter.

    Since the description of "universality" is one of the most important attributes of "human rights" recognized in the present age, the theorists have extensively attempted to analyze the principles of universality of human rights. Moral theories as extra-legal solutions are one the most important directions to achieve this goal in a way that recognizing the human rights norms as moral ones have been the greatest reason for proving the universality of human rights. The examination of moral theories having the capacity of presenting the universal norms indicates the allegations posed in this regard aren’t true; Even the Kant’s moral theory presenting the moral rules as universal and humanistic, in addition not to cover a very important part of the human rights aspects, is faced with many theoretical problems. The research method is analytical.

    The Security Council as prime responsible for international peace and security has been prepared by special authorities in achieving the objectives envisaged in the Charter of the United Nations. The Security Council Such as other UN organs is obliged to obey the Purposes of the UN including “to achieve international cooperation in promoting and encouraging respect for human rights and fundamental freedoms for all”. On the other hand, a large number of basic human rights norms as being part of general international law oblige all international actors to respect them and any violations by them of such norms reach to international responsibility. However, some of actions of the UN Security Council were incompatible with obligations incumbent upon it, especially in context of established human rights and humanitarian law norms. Sanctions that directly or indirectly cause deaths would be a violation of the right to life. Other human rights could also be violated by sanctions regimes, such as the rights to security of the person, health, education or employment. Obviously, such measures must be viewed as illegal in context of human rights and humanitarian law, therein engage the responsibility of the UN Security Council. This article with descriptive and analytical approach investigates the UN Security Council's responsibility in viewpoint of human rights norms and evaluates some of challenges in this area.

    Drawing the international human rights provides an inharmonious appearance in which disproportionality of its dominant political image in comparison to the other frail parts will exhibit a wretched caricature image. But the cornerstone of contemporary human rights is based on the solution of extensive inequalities and socio-economic pains followed by the world wars and international conflicts after it which has become a persistent international problem. Therefore, the main question of this research is: “What is the role of human rights norms in solving the socio-economic inequalities”? This article with a cultural approach in the framework of the critical school theory has attempted to examine this aspect of human rights. Two main characteristics of this theory are the explanation of the ineffectiveness of “status quo” so as to achieve the “good status” as well as its effort to intersubjective issues like culture, norms and common sense. At the end, there will be some solutions involving new concepts and discourses offered to design new international structures while expressing the present challenges.
