    روند توسعه تدریجی حقوق بین الملل به سمت تحقق حقوق بشر به نحوی است که قواعد آمره حقوق بین الملل رفته رفته رنگ و بوی حقوق بشری می گیرد. با این تحول بزرگ، نقش سازمان های بین المللی همچون اوپک در امر توسعه و کاهش فقر درخور توجه است. از سویی، به جهت اینکه بهبود حقوق بشر محیط مناسبی برای توسعه اقتصادی را فراهم می کند، نقش اوپک در قامت یک سازمان اقتصادی نیز پررنگ تر می شود. مقاله پیش رو، با مفروضات بالا و با ملاحظه موجبات پایبندی اوپک به رعایت حقوق بشر، به بررسی رویکرد هنجاری و عملی این سازمان می پردازد و به این نتیجه می رسد که اوپک، چه در قالب شرکت های تجاری و چه در قالب سازمان های بین المللی، ملزم به رعایت حقوق بشر است؛ اما در عین حال، از توجه توامان به همه نسل های مختلف حقوق بشر غافل بوده است.

    نفت از عمده ترین علت های آلودگی دریاهاست و از جمله مهم ترین منابع آلودگی نفتی دریاها، می توان به آلودگی ناشی از کشتی ها و آلودگی ناشی از فعالیت در بستر دریاها اشاره کرد. مسئولیت مدنی ناشی از آلودگی نفتی در دریا، مسئله ای است که ابعاد پیچیده ای دارد که سال هاست مجامع بین المللی و به ویژه کشورهای ساحلی را به تکاپو انداخته است. با توجه به اینکه آلودگی نفتی به جهت ماهیت سیال آب دریا، خسارت بسیار سنگینی را متوجه محیط زیست دریا و اقتصاد کشورهای ساحلی می کند، بنابراین جبران خسارت و پیشگیری از آن به عنوان یکی از کارکردهای مهم مسئولیت مدنی مورد توجه است. در این نوشتار، به بررسی انواع خسارت های ناشی از آلودگی نفتی و نحوه جبران خسارت و منابع جبران کننده آن، ازجمله بیمه ها و کلوپ های P&I و همچنین فرایند رسیدگی قضایی به آلودگی نفتی و دادگاه های حاکم بر آن در دریاها پرداخته شده است.

    تحریم های هسته ای اتحادیه اروپایی، مجموعه ای از اقدامات محدودکننده بود که آثار سوء آن، بیش از هر بخش دیگری از کشور، در صنعت نفت ایران که صنعت اصلی کسب درآمد کشور است، نمایان شد. این اقدامات محدودکننده تا بدان جا پیش رفت که شرکت های مشمول تحریم ها، نه تنها از انجام هرگونه معامله و سودآوری در حوزه صلاحیت اتحادیه منع شدند، بلکه تمامی دارایی ها و منابع آن ها نیز توقیف شد. مقاله پیش رو، می کوشد با بررسی قوانین و رویه قضایی شکل گرفته از دعاوی تحریمی، معیارهای حقوقی تحت شمول تحریم قرار گرفتن را استخراج کرده و با وضعیت شرکت های مورد نظر تطبیق دهد تا تصویر روشنی از چرایی تحریم شدن شرکت های نفتی ایرانی در اتحادیه اروپا ترسیم شود.

    برچیدن واحدهای شناور تولید، فرآورش و ذخیره سازی نفت و گاز به عنوان پدیده هایی اختلافی مطرح هستند و با توجه به ویژگی های فنی، از رژیم حقوقی صنعت دریایی و صنعت نفت و گاز تبعیت می کنند. رژیم حقوقی حاکم بر این واحدها، از حیث بین المللی و نظام های حقوقی کشورها، از موضوعات چالش برانگیز است؛ چه این واحدها براساس اهداف کنوانسیون ها و نظام های حقوقی کشورها، موضوع رژیم های حقوقی متفاوت قرار می گیرند. در برخی کشورها از رژیم حقوقی سازه ها و تاسیسات نفتی فراساحلی و در برخی دیگر از رژیم حقوقی کشتی تبعیت می کنند. امروزه با توجه به رویکرد متفاوت دولت ها و ابهام در وضعیت حقوقی این واحدها، و با توجه به نبود کنوانسیون و عرف بین المللی مربوط به آن ها، از یک سو و پیچیدگی رژیم حقوقی این واحدها، از سوی دیگر، ایجاد قواعد یکسان در حقوق کشورها و رویه و عرف بین المللی در زمانی نزدیک ممکن نیست و در نتیجه، در موقعیت کنونی قواعد حاکم بر برچیدن تاسیسات نفتی فراساحلی در برخی موارد، با در نظرگرفتن پیچیدگی ها و ویژگی های فنی، اهداف ساخت و نوع عملکرد بر این واحدها قابل اعمال است.

    اجرای اصل مشارکت عمومی در داوری های مربوط به اختلافات نفتی، مستلزم این است که اشخاص یا گروه هایی از عموم مردم که طرف داوری نیستند، بتوانند از طریق تقدیم لایحه کتبی، دسترسی به اسناد مهم داوری و حضور در جلسه رسیدگی، در جریان داوری مشارکت داشته باشند. قواعد داوری سرمایه گذاری طی اصلاحات اخیر و معاهدات دوجانبه سرمایه گذاری در نسل جدید خود به سوی اجرای این اصل گام برداشته اند. مقاله پیش رو، به دنبال تحلیل نقش مراجع داوری سرمایه گذاری در اجرای اصل مشارکت در رویه داوری های نفتی است. بررسی دو قضیه نفتی منتشرشده که دیوان داوری در یکی، به اجرای اصل مشارکت عمومی و در دیگری، به رد این اصل حکم داده، نشانه دو مطلب است: 1. اهمیت تصریح به اصل مشارکت در قواعد داوری و معاهدات سرمایه گذاری؛ 2. عدم تمایل دیوان های داوری به استفاده از قاعده بند 3 ماده 31 کنوانسیون وین در تفسیر معاهداتی که نسبت به اجرای اصل مشارکت ساکت هستند. در قضیه لونپاین علیه کانادا، با وجود مخالفت سرمایه گذار، دیوان داوری بر مبنای صراحت ماده 37 ایکسید و بیانیه نفتا در مشارکت ثالث، لایحه کتبی دو سازمان مردم نهاد را پذیرفت. اما در مقابل، در قضیه شورون علیه اکوادور، عموم از مشارکت در داوری نفتی بازماندند. سکوت معاهده سرمایه گذاری اکوادور- ایالات متحده در مورد امکان مشارکت عمومی و همچنین ضمنی و کلی بودن اختیار داوری مندرج در ماده 15 قواعد آنسیترال سال 1976، می تواند از دلایل رد شدن مشارکت عمومی در این قضیه در سال 2011 شمرده شود.

    مقاله پیش رو، به منظور شناسایی اهداف و منافع کشورهای نفتی، به ویژه ایران، در انعقاد قراردادهای حوزه های اکتشاف، توسعه، استخراج و تولید نفت و گاز با شرکت های بین المللی در مقابل اهداف و منافع آن ها، سامان یافته است. این پژوهش، از دو روش اسنادی و کتابخانه ای و نیز پیمایشی با مصاحبه ساختاریافته با نخبگان انجام شده است. نتایج پژوهش نشان می دهد اهداف و منافع دو طرف قرارداد بسیار گوناگون است. این اهداف و منافع برای کشور میزبان، حوزه درآمدها و هزینه ها، فناوری، اقتصاد داخلی، بهره برداری فنی، اقتصادی و صیانتی از مخازن و نیز کسب اطلاعات را دربر می گیرد. در مقابل، اهداف و منافع شرکت ها، حوزه درآمدها و هزینه ها، فناوری، اقتصاد کشور مادر، حفظ انحصارات و نیز اطلاعات را شامل می شود. بنابراین، لازم است راهبردهای مناسب برای رسیدن به اهداف و منافع در تنظیم و تدوین قراردادهای نفتی نیز در طول مذاکرات مورد توجه قرار گیرد که نوشتار حاضر در این باره پیشنهادهایی را ارائه داده است.

    انعطاف پذیری در قراردادهای حوزه انرژی اهمیت بسزایی دارد که می تواند تضمین کننده تداوم و اجرای مناسب آن ها باشد. این موضوع در قراردادهای بلندمدت چشمگیرتر است. قراردادهای حفاری نیز که از قراردادهای بالادستی فرعی است، گاهی مشمول مفهوم قراردادهای بلندمدت قرار می گیرد؛ از این رو، باید فروض مختلف و به تبع آن، سازوکارهای قراردادی مناسب برای ایجاد انعطاف پذیری در آن ها پیش بینی شود. با توجه به تغییرات احتمالی، به ویژه در شرح کار، شرایط اجرای عملیات و بهای نفت، طراحی قراردادهای منعطف و پیش بینی شروط مناسب جهت تداوم قراردادی و یا حفظ تعادل آن، امری ضروری است. پیش بینی نرخ های احتیاطی، نرخ مشروط، امکان تعدیل، مذاکره مجدد و تعلیق، می تواند از مهم ترین سازوکارهای ایجاد انعطاف پذیری باشد. بنابراین، هدف مقاله پیش رو، بررسی قراردادهای حفاری روزانه و سازوکارهای مناسب در جهت پویایی این دست قراردادهاست.

    بلایای طبیعی و انسانی بخش گریزناپذیری از حیات است که ابعاد گوناگون زندگی انسان ها را تهدید می کند. امروزه با افزایش میزان بحران آب در جهان، توجه جامعه بین المللی به موضوع امنیت آب جلب شده و نقش مدیریت بلایا، به معنای آمادگی، واکنش و بازسازی به منظور کاهش آثار بلایا، در حصول امنیت آب مورد توجه قرار گرفته است. این پژوهش، به بررسی رابطه متقابل امنیت آب و مدیریت بلایا و کنکاش در قواعد ذی ربط حقوق بین الملل موضوعه پرداخته است. دستاورد بررسی های توصیفی و تحلیلی نگارندگان، حاکی از آن است که گرچه تاکنون سند حقوقی الزام آور یکپارچه ای در موضوع مدیریت بلایا در حقوق بین الملل شکل نگرفته است، اما برخی از قواعد شاخه های مختلف این حقوق، از جمله حقوق بین الملل بشر، حقوق بین الملل محیط زیست، حقوق بین الملل منابع آبی فرامرزی، تعهداتی را در مراحل مختلف مربوط به بلایا، یعنی پیش از وقوع آن ها، در هنگام وقوع و پس از آن، بر عهده بازیگران عرصه بین المللی، به ویژه دولت ها، قرار می دهد که در تامین امنیت آب نقش بسزایی دارد؛ هرچند تضمین پاسداشت این تعهدات، خود چالشی مهم است که نیازمند چاره اندیشی جهانی است.

    در دنیای امروز نقش دریاها و اقیانوس ها در زندگی جاری و روند توسعه، مهم و انکارناپذیر است. با عنایت به تنوع بهره برداری ها و احتمال بروز اختلاف میان کشورها، وجود دیوانی بین المللی ضروری است. کنوانسیون حقوق دریاها، مهم ترین و جامع ترین سند موجود در مورد حقوق دریاهاست که یک سامانه کامل، متنوع و کارآمد در زمینه حل وفصل اختلافات بین المللی پیش بینی کرده است. دیوان بین المللی حقوق دریاها به عنوان نهاد قضایی مستقل، از روش های پیش بینی شده در این کنوانسیون است. این دیوان، افزون بر آن که مرجعی قضایی برای حل وفصل اختلافات بین المللی در زمینه دریاهاست، می تواند از طریق ایجاد عرف و رویه یکسان در توسعه حقوق بین الملل دریاها نقش مهمی را ایفا نموده و یکی از موثرترین و مناسب ترین ابزارهای تطبیق قواعد حقوق دریاها با شرایط متغیر موجود باشد.

    آزمایش هسته ای، نه تنها تهدیدی علیه صلح و امنیت جهانی به شمار می آید، بلکه متناسب با روشی که انجام می شود، درجه های مختلفی از آلودگی زیست محیطی را نیز پدید می آورد. بدین منظور، اگرچه کنشگران نظام حقوق بین الملل با انشای معاهده های قطب جنوب، منع موقتی، جامع آزمایش هسته ای و منع سلاح هسته ای به ترتیب در سال های 1959، 1963، 1996 و 2017، ممنوع انگاری آزمایش های هسته ای را در دستور کار قرار دادند، ما اسناد مذکور دارای چنان نارسایی ها و ابهام هایی هستند که هنوز نتوانسته اند راهبرد حقوقی شایسته ای را در برابر آزمایش های هسته ای به وجود آورند. از این رو، مهم ترین آسیب های معاهدات یادشده را حسب مورد عدم تعریف آزمایش و انفجار هسته ای و تعیین قلمرو آن، غفلت از تبیین مسئولیت مدنی و سازوکار جبران خسارت ناشی از آزمایش های هسته ای، ایجاد شرایط دشوار برای لازم الاجراشدن و امکان شرط انصراف تشکیل می دهند. افزون بر نارسایی های حقوق بین الملل قراردادی، در میان سایر منابع حقوق بین الملل نیز حکم صریحی مبنی بر ممنوعیت آزمایش هسته ای دیده نمی شود. با این اوصاف، در جستار پیش رو، بر آنیم تا با تبیین نظام حقوقی حاکم بر ممنوعیت آزمایش های هسته ای در حقوق بین الملل، مهم ترین آسیب های آن را انشا و راهکارهایی برای آن ها ارائه کنیم.

    حفاظت از محیط زیست یکی از ابعاد مهم توسعه پایدار است که در تمامی فعالیت های اقتصادی، به ویژه پروژه های نفتی باید مورد توجه قرار گیرد. شروط زیست محیطی قراردادهای نفتی با اینکه تا حدود زیادی متاثر از معیارهای همسان بین المللی است، در قراردادها و پروژه های مختلف جلوه های گوناگونی به خود می گیرد. ضوابط حاکم بر محیط زیست، طرح ها و برنامه هایی که پیمانکار ملزم به تبعیت از اجرای آن هاست، لوازم مدیریت زیست محیطی پروژه که به دنبال رویارویی موثر با مشکلات زیست محیطی است و در پایان، مسئولیت ناشی از خسارت های زیست محیطی، مبانی و حدود آن، مهم ترین موضوعات زیست محیطی است که در قراردادهای نفتی به تفصیل از آن بحث می شود و تحلیل مسائل آن با تاکید بر قراردادهای نفتی جدید و برخی دعاوی زیست محیطی، موضوع بررسی مقاله پیش روست.

    همچنان که حقوق نفت و گاز با حقوق تجارت بین الملل تفاوت های متعددی دارد، حقوق حمل ونقل نفت و گاز و به طور ویژه، حقوق حمل ونقل دریایی آن نیز در مقایسه با قراردادهای حمل ونقل دارای ویژگی های خاصی است. این ویژگی ها از یک سو، در ضرورت عملی استفاده از قالب های قراردادی خاص، محدودیت انتخاب طرف قرارداد و شروط منحصر به فرد نمایان می شود که رعایت شروط فنی، شرط تبعیت، شرط مصونیت حاکمیتی و شرط تحدید مسئولیت مالک کشتی، از مصادیق روشن آن است. از سوی دیگر، ویژگی های خاص حمل ونقل دریایی نفت و گاز ناظر به معیارهای ایمنی خاص داخلی و بین المللی، اینکوترمز اختصاصی، الزامات سازمان جهانی تجارت و محدودیت های قانونی بین المللی است. سرانجام، این ویژگی ها، به ضرورت استفاده از نیروی انسانی متخصص، هزینه های متفاوت، تسهیلات وارداتی و زیان های خاص ناشی از دریایی بودن حمل ونقل نفت و گاز مربوط می شود. این وجوه ممیزه انتقال دریایی نفت و گاز ایجاب می کند در تنظیم قرارداد، به آن ها توجه ویژه ای شود تا ریسک قراردادی احتمالی تا حد ممکن مدیریت شود.

    The gradual development of international law towards the realization of human rights is in such a way that the Jus cogens of international law gradually take on human rights. With this enormous transformation, the role of international organizations such as OPEC on development and poverty alleviation is worth paying attention. With the above assumptions and also considering the requirements of OPEC for compliance with human rights, this article investigates the normative and practical approach of the organization and concludes that OPEC, either in the form of commercial companies or in the form of international organizations, is required to respect human rights. But at the same time, OPEC has neglected to pay attention to all generations of human rights.

    Oil is the main cause of pollution of the seas and some of the most important sources of oil pollution of the seas are pollution derived from ships and pollution from activities on the seabed. Civil liability arising from oil pollution at sea is an issue with complicated dimensions, which has led to efforts of international community, particularly the coastal countries for many years. Given the fluid nature of sea water oil pollution leads to heavy damages to the environment of the sea and economy of coastal countries. Therefore, compensation of the damage and prevention of oil pollution is considered as one of the important functions of civil liability.     Nuclear-related economic sanctions of EU against Iran were a set of restrictive measures which the negative impact of these measure was felt more in Iran’s oil and gas sector, as the main income generating sector of Iran’s economy. These sanctions were applied to the extend that the designated entities were not only prohibited from doing any transaction with elements of the EU jurisdictions, but also all their assets and economic resources were frozen. This article reviews the relevant laws and legal precedent which has been formed over the sanction’s disputes and delisting cases and by studying the legal elements of designating an entity and the legal situation of Iranian oil companies under EU Sanctions, presents a better picture of the reason and logic behind listing of Iranian oil companies in the EU list of designated entities.

    Decommissioning Floating Production, Processing, Storage and Offloading of Oil and Gas units as new phenomena, follow the technical rules related to the legal regime of the marine and oil and gas industries. The legal regime applicable to these units in International and domestic systems is a challenging one, because these units are subject to various local laws and international conventions that peruse different objectives. In some countries they are subject to the legal regime of marine structures, while in some others they follow the legal regime of ships. At present, considering the discrepancies in the approaches of states and the ambiguity as to the legal status of these units on the one hand, and in the absence of a comprehensive international convention or international customs on the other hand, the unification of the rules relating to these units seems unlikely in the near future. Nevertheless, in the current situation it seems appropriate if one can apply the legal status of marine structures and installations to the floating production, processing, storage and offloading units with due regard to the technical complexity, objective of the instruction, and type of function.

    Implementing the principle of public participation in oil disputes requires that individuals or groups of public who are not parties to arbitration can participate through presentation of written submission, access to important arbitration documents and attendance in arbitration hearings.The rules of international arbitration in the recent reforms and bilateral investment treaties in the new generation have taken the course of implementing this principle.This article seeks to analyze implementation of the principle of participation in the framework of arbitration proceedings. In this paper,two petroleum cases has been reviewd.One has been ruled by a arbitration tribunal to enforce the principle of public participation and the other have rejected this principle.The study indicates,firstly,the importance of stipulating the principle of participation in arbitration rules and investment treaties, and secondly lack of willingness of tribunals to implement the rule of article 31(3) of the Vienna Convention.In LonePine v.Canada, despite the investor's disagreement, tribunal accepted the written submission of the two NGOs on the basis of ICSID Article37 and NAFTA's statement.Contrary, in Chevron v.Ecuador,the public were not allowed to participate.The silence of the Ecuador-US BIT as well as the implicit authority set forth in Article 15 of UNCITRAL(1976) could be regarded as grounds for the rejection.

Therefore, it is necessary to consider the appropriate strategies for reaching the Objectives and benefits in setting up an oil contracts, especially during the negotiations

    Flexibility in long term contracts of energy sector has importance which can guarantee their contractual proper performance. Drilling contracts as secondary upstream contracts are being influenced by oil price fluctuation. This matter not only affects contractual balance but also is in contrast with underlying mutual agreement regarding applying of rates equal to market rates. Therefore proper contractual mechanism shall be incorporated in contracts to make possible to adjust and modify contractual rates in accordance with market conditions. Determining a suitable index for adopting rates and set dimension for modification of rates can provide required flexibility in these contracts. In addition to using renegotiation as an independent clause, it can be used as a supplementary clause to manage the inefficiency of using adaptation clause. However, this article aims to examine Day Rate Drilling Contracts and proper mechanism for modification of them.

    Natural and man-made disasters are an inevitable part of life which threaten various dimensions of human life. Nowadays, increasing the water crisis, in all around the world, attracts the attention of international community to the issue of water security and the role of disaster management in the sense of preparedness, response and reconstruction in order to reduce the impact of disasters in accessing water security has been taken into consideration. This investigation has studied interaction of water security and disaster management and explored the rules of applicable International law in this topic. the descriptive and analytical studies of the authors shows that although, there is no binding coherent legal document on disaster management in international law, but some provisions of various areas of it including international human rights, , international environmental law, international law of transboundary water resources and etc., impose obligations on international actors, particularly States, in the various stages of disasters including, before, during and after them, which play a significant role in providing water security. Even though, ensuring compliance with these obligations is an important challenge that requires global thinking.

    In today's world, role of the seas and oceans in the livelihood and the process of development is essential and undeniable. Considering the diversity in operations and the probability of disagreements among countries, the existence of an international tribunal is required. The UN Convention on the Law of the Sea is the most important and comprehensive instrument on the law of the seas, providing a diverse and efficient system for settlement of international disputes of the field. The International Tribunal for the law of the Sea(ITLOS), as an independent judicial body, is one of the methods proposed in this Convention. The Tribunal can play not only an important role as a judicial forum of dispute settlement but also can assist formation of customary international law and practice and in turn development of international law. In fact, this Tribunal can go beyond a court and act as one of the most effective and appropriate instruments for implementing the rules of the law of the seas with varying conditions.

    Nuclear testing is not only a threat to peace and security of the world, but it could cause different levels of environmental pollution in accordance with the forms of its occurrence. Although the activists of international law regime have created the Antarctic Treaty, the Partial Nuclear Test Ban Treaty, the Comprehensive Nuclear Test Ban Treaty, The Prohibition of Nuclear Weapons in 1959, 1963, 1996, and 2017, respectively, but the aforementioned instruments have inadequacies and ambiguities that are caused not to create a suitable legal strategy to confront nuclear testing. Accordingly, the most important flaws of the aforementioned treaties are the lack of transparent definition of the nuclear test and explosion and their scope, the neglect of civil responsibility and the drawing up of the mechanism for compensating for nuclear tests, the creation of difficult conditions for their entry into force and, the possibility of a withdrawal clause. Furthermore, there is no explicit mandate to ban nuclear testing among other sources of international law. Therefore, during this essay, it aims to recognize and remove the flaws in the field of nuclear testing by explaining the legal system governing the prohibition of this type of testing in international law.

    Abstract Environmental protection is an important aspect of sustainable development that should be considered in all economic activities, including petroleum projects. The environmental clauses of petroleum contracts, despite being largely influenced by international unified standards, have various faces on different contracts and projects. The most important of environmental issues are included: Environmental governing law, the plans and program that the contractor must comply with, environmental management requirements for the project that seek to deal effectively with environmental problems and at the end, civil liability due to environmental damages, its foundations and its limitations.     As there are many differences between oil and gas law, and international trade law, so oil and gas transportation law and therefore oil and gas maritime transportation law has exclusive specifications in comparison with maritime law. In the article, authors tried to list this specifications. These are related to type of contract, different clauses including technical, compliance, immunity and limitation of liability. In addition, safety standards, specific incoterms, world trade organization regulations, experienced personnel, various costs, import facilitations, and damages of transportation are inspected. These specifications need to be considered while formation of contracts, therefore contractual risks would be managed, controlled and decreased.
