    در مفهوم شناخته شده از داوری که داوری اختیاری نامیده می شود طرفین با خواست و اراد ه خویش داوری را به عنوان مرجع حل و فصل اختلافات تعیین می کنند که به دلیل وجود عنصر «اراده»، منافع شخصی و خصوصی افراد به نحو بیشتری تامین می گردد، در حالی که در نقطه مقابل آن و در داوری اجباری، اراده و حکم قانون گذار جایگزین اراده شخصی افراد می شود و طرفین با لحاظ منافع عمومی و توسط قانون گذار، مکلف به رجوع به داوری می گردند. البته میزان و شدت اجبار، در همه اقسام داوری های اجباری به یک میزان نیست و در پاره ای از موارد، منافع عمومی و خصوصی در عرض یکدیگر مورد توجه قرار می گیرند. همین اجبار در رجوع به داوری، موجب شده است تا گروهی آن را مغایر با اصل 34 قانون اساسی و حق افراد در رجوع به دادگاه بدانند که مهم ترین دلیل رد آن می تواند تایید قوانین ناظر بر داوری های اجباری توسط شورای نگهبان باشد؛ زیرا شورای مذکور طبق اصل 72 قانون اساسی، مرجع رسمی انطباق مصوبات مجلس شورای اسلامی با قانون اساسی است. از سوی دیگر، با وجود اجبار در رجوع به داوری، مفهوم کلی داوری از میان نرفته و بسیاری از مزایای داوری، از جمله رسیدگی توسط اهل فن و متخصص مربوطه، سرعت در رسیدگی، و اجرای آسان آرای داوری در آن محقق است؛ اما در هر حال، ضرورت شناخت و توجیه داوری اجباری از آن روست که صرفا مفهومی انتراعی نیست و نه تنها در قوانین به کار رفته و احکامی ناظر بر اجبار افراد در رجوع به داوری وضع شده اند، بلکه در آرای قضایی نیز صراحتا به عنوان و ماهیت «هیئت داوری تکلیفی» اشاره شده است.

    با پیشرفت زندگی و به وجود آمدن شرایطی که در زمان ابلاغ دین وجود نداشته است، نیاز به تدوین قانون از سوی شارع بیشتر احساس می شود. در عصر غیبت و بسته بودن ابواب علم، تدوین قانون، تفقه و اعلام حکم شارع در مسائل مستحدثه، به فقها واگذار شده است. همچنین در دورانی که حکومت اسلامی شیعیان پس از سالیان طولانی تشکیل شده است، نیاز به اجرای قوانین وضع شده از جانب شارع و تدوین قوانین برای موضوعات مستحدثه به وسیله فقها، بیشتر احساس می شود. پرسش اصلی پژوهش، چگونگی ایجاد تعامل میان شرع و قانون است که با روشی تحلیلی و توصیفی به پاسخ آن پرداخته شده است. به دلیل اهمیت تدوین قانون برای حکومت اسلامی، اندیشمندان فقه و حقوق بر آن شدند تا با بررسی شرعی بودن قوانین مصوب فقهای نهاد شورای نگهبان، مشکل شرعیت آن را رفع نمایند؛ از یافته های پژوهش می توان به این موارد اشاره کرد: الف. به دلیل گسترش مسائل روز و نیاز به تصویب قوانین جدید، گاه قوانینی به تصویب می رسند که پس از بررسی اجتهادی، نیاز به مطابقت آن با دین اسلام هست. به همین دلیل، فقهای شورای نگهبان بعضا قوانینی را که مجلس برای تایید به شورای نگهبان ارسال می دارد، فاقد شرایط شرعی می دانند و آنها را برای رفع اشکال و نقص به مجلس.باز می گردانند؛ ب. برخی از قوانین کارآمدی خود را از دست داده اند و به تصویب قوانین جدید تر نیاز است، ج. با بررسی دقیق تر برخی قوانین، عدم مطابقت با دین اسلام در آنها دیده می شود که نیاز به اصلاح دارند.

    سیاست جنایی یک کشور، مجموعه تدابیر و روش هایی است که هیئت اجتماع از جمله دولت در معنای عام آن برای پاسخ دهی به پدیده مجرمانه به کار می برد. بخش عمده ای از این تدابیر، در وظایف و روابط قوای سه گانه، نهادها و سازمان های ساختار سیاسی یک کشور اعمال و تعریف می شوند. دو قوه قضائیه و مجریه نقش مهمی در سیاست جنایی و برخورد با پدیده مجرمانه در سطوح تقنینی، قضایی و اجرایی ایفا می کنند. مبتنی بر نظام استقلال قوا در جمهوری اسلامی ایران، هر کدام از قوا دارای عملکرد مستقل در برخورد با پدیده مجرمانه اند؛ لیکن این استقلال را نمی توان بدون داشتن روابط میان آنها تصور کرد؛ چرا که این قوا برای یک کشور و در راستای مبانی و اهداف آن انجام وظیفه می کنند. این پژوهش با رویکردی تحلیلی توصیفی در مقام پاسخ به چگونگی روابط قوای مجریه و قضائیه در قلمرو تدابیر سیاست جنایی تقنینی، اجرایی و قضایی است که به نظر می رسد این دو قوه ضمن داشتن استقلال، دارای دو نوع روابط تعاملی و کنترلی در قلمرو سیاست جنایی تقنینی و قضایی هستند.

    سابقه بحث ولایت فقیه و ادله آن، مساوی با عمر فقه شیعه است؛ اما نظرات برخی فقها درباره موضوع ولایت فقیه متفاوت با نظر مشهور و گاهی متعارض با آن است. یکی از فقهای مطرح معاصر که به عنوان صاحب اندیشه ای متفاوت در این موضوع مطرح می گردد، حضرت آیت الله خویی است. پرسش این نوشتار این است که خدشه ایشان در برخی ادله ولایت فقیه، به ویژه ادله نقلی، به معنای رد این موضوع از منظر ایشان است؟ در پاسخ به این پرسش، ابتدا با روش توصیفی تبیینی به ایرادات ایشان به برخی ادله پرداخته خواهد شد؛ سپس با روش تحلیل انتقادی به مطالب دیگری اشاره می شود تا مشخص شود آنچه به عنوان ادله خدشه در موضوع ولایت فقیه از منظر ایشان مطرح می گردد، حاوی تمام نظرات ایشان در این زمینه نیست و محدوده ولایت فقیه در نظر ایشان از طرقی دیگر قابل اثبات است و خود ایشان نیز در مقام عمل، اعمال ولایت نموده اند.

    مفهوم حق تعیین سرنوشت در حقوق بین الملل، از دهه 1950 میلادی به این سو تکامل داشته است؛ به ویژه در نسبت با حق حاکمیت، یکپارچگی سرزمینی، جدایی طلبی، استقلال طلبی و خودمختاری؛ و این تکامل همچنان ادامه دارد. این پژوهش به بررسی تحول مفهوم حق تعیین سرنوشت از مجرای رویه قضایی دیوان بین المللی دادگستری، مشتمل بر قضایای استعمارزدایی آفریقای جنوب غربی (نامیبیای کنونی) (1949-1971)، صحرای غربی آفریقا (1975)، تیمور شرقی (1995)، ساخت دیوار حائل در سرزمین فلسطین اشغالی (2004) و اعلامیه استقلال کوزوو (2010) می پردازد. تحول مفهومی حق تعیین سرنوشت به گونه ای بوده است که از صرف قابلیت اعمال به فرایندهای استعمارزدایی، اکنون موجب به رسمیت شناخته شدن حق استقلال ساکنان سرزمین های غیرخودمختار، امکان اعلام یک جانبه استقلال و جدایی طلبی تحت شرایط خاص، برگزاری همه پرسی آزاد و حقیقی برای تحقق این حق، و شناسایی تعهدات دولت های ثالث شده است. با وجود این، قضات دیوان هنوز از فرصت های فراهم شده برای تدقیق مفهوم حق تعیین سرنوشت، تعریف مردم (اقوام)، شرایط دارا شدن وضعیت دولت، مشخص کردن تعهدات دولت های ثالث، و تعیین موضع حقوق بین الملل در برابر اعلام یک جانبه استقلال و جدایی طلبی بهره نبرده اند.

    انسان در اصل تکوین و ذات خویش، به واسطه بر خورداری از روح و عقل الهی، موجودی صاحب کرامت و اختیار است و این کرامت و آزادی، عطیه الهی است که برای همه انسان های جهان، از هر نژادی و رنگی، به طور مساوی مفروض و مسلم است و هرگونه بر تری طلبی بر پایه ملیت، نژاد، رنگ، پوست، مال، ثروت و موقعیت های اجتماعی، خانوادگی، قومی و مانند آن، ممنوع و منافی با کرامت ذاتی نوع بشر است. این مقاله با روش توصیفی تحلیلی و با هدف بررسی و تحلیل نسبت کرامت با آزادی در دو تفکر اسلام و لیبرالیسم به سرانجام رسیده و در صدد پاسخگویی به این پرسش مهم است که تفاوت مکتب اسلام با نگاه لیبرالیسم به کرامت و نسبت آن با آزادی چیست. یافته های تحقیق حاکی از آن است که لیبرالیسم با تاکید بر کرامت ذاتی و آزادی مطلق انسان، هیچ رفتار و عملی حامل تحدید یا تقیید را بر نتابیده است و این دو ویژگی (کرامت و آزادی) هیچ گاه و در هیچ حالتی، از انسان جدا شدنی نیست؛ حتی اگر مرتکب بزرگترین جنایت شود. بنابر این، کرامت او مطلق بوده و او برای انتخاب هر چیزی آزاد است و هر عملی که از او سر زند، نمی تواند او را از کرامت ذاتی بیندازد. انسان گرایی، عقل خود بنیاد و آزادی مطلق، از مهم ترین مبانی کرامت ذاتی در تفکر لیبرالیسم است. در مقابل، مکتب وحیانی اسلام، افزون بر بیان کرامت ذاتی آدمی، به کرامت ارزشی و آزادی مسئولانه او نیز توجه کرده است؛ به این بیان که انسان به موجب عمل و تلاش خود، این مرتبه از کرامت را کسب می کند و موجب رشد و تعالی خود را فراهم می سازد. این کرامت بر مبانی ای استوار است که مهم ترین آنها عبارت اند از مسجود فرشتگان بودن؛ جانشینی خدا، امانت داری؛ علم ویژه خدادادی؛ تسخیر موجودات؛ اشرف مخلوقات بودن؛ آزادی و اختیار داشتن؛ تقوا؛ عقل و فطرت الهی.

    In the general concept of arbitration-which is called voluntary arbitration-the two sides willingly take to arbitration for the settlement of disputes, and due to the existence of “will”, the personal and private interests of individuals are more fully served, while in compulsory arbitration, the personal will of an individual is replaced by the legislator‟s will and, taking into regard public interests and mediation of the legislator, the two sides are obliged to go to arbitration. Of course, the amount and intensity of compulsion is not the same in all types of compulsory arbitration, and in some cases, public and private interests are equally considered. The very compulsion in referring to arbitration has led some to hold that it is contrary to Article 34 of the Constitution and individuals‟ right of going to court, and the most important reason for rejecting it may be the Guardian Council‟s approval of the laws governing the types of compulsory arbitration; because, according to the Article 72 of the Constitution, the Guardian Council is the official authority for ensuring the compatibility of the pieces of legislation passed by the Islamic Consultative Assembly with the Constitution. On the other hand, with the existence of compulsion while referring to arbitration, the overall concept of arbitration is still in effect and many of the advantages of arbitration are gained, including pursuit of investigation by technologists and professional experts, completing investigation in a short time, easy way of making arbitration decisions. However, the necessity to recognize and justify compulsory arbitration arises from the fact that it is not a mere abstract concept and not only used in laws-and that decrees on the compulsion of individuals to refer to arbitration have been legislated-but, also there is an explicit reference to it in judicial decisions under the title and the nature of “Executive Arbitration Board”

    With the advances which occurred in the different aspects of life and emergence of the conditions that did not exist at the time of the proclamation of religion, it is felt that there is an increasing need for legislation. In the Age of Occultation and with the closure of the doors of religious science, making laws, acquiring knowledge of religion and establishing shar‟i injunctions relating to novelties have been entrusted to religious jurists. Likewise, now that a Shiite Islamic government has come to existence after many years, there is a greater need to enforce laws laid down by Islamic law and formulate laws on the newly-raised issues by religious jurists. The main question raised by this research is about how to establish interaction between law and Sharia. The author expounds this question, using an analytical and descriptive method. Due to the importance of making a special law for the Islamic State, fiqh and law scholars have decided to solve the problem of the legality of the laws approved by the jurists of the Guardian Council by examining their compatibility with Sharia. The findings of the study can be summarized as follows: a. due to the extensive range of the issues of the day and the need to adopt new laws, the laws which are adopted after Ijtihad-based examination, have to be in accord with the religion of Islam. For this reason, the religious jurists of the Guardian Council sometimes find that the laws which the Islamic Consultative Assembly sends to them for approval are not in accord with Sharia and so they return them to the Islamic Consultative Assembly for remedying defects in them; b. some laws are no longer effective and there is a need to enact newer laws; and c. on inquiry, some laws are found incompatible with Islam and they have to be set right.

    A country's criminal policy is a set of measures and methods used by the community body, including the government, in its general sense, to respond to the phenomenon of crime problem. Most of these measures are implemented and defined through the functions and relationships between the three powers, institutions and organizations of the country's political system. Both the judiciary and the executive power play a significant role in criminal policy and in dealing with the phenomenon of crime problem at the legislative, judicial and executive levels. According to the order of independence of the powers in the Islamic Republic of Iran, each power has an independent function in dealing with the phenomenon of crime problem, but this independence cannot be considered without observing the relations between them because all these powers work for establishing the principals and achieving the goals of their own country. Using a descriptive-analytical approach, this article examines the question about the kind of relations between the executive and judicial powers in the realm of implementing legislative, executive and judicial criminal policy that makes the two powers, while independent, seem to have two types of relations, i.e. interactive and controlling in the realm of legislative and judicial criminal policy.

    The history of the discussion and arguments concerning Velâyat-e Faqih goes back to the early development of Shiite Fiqh (jurisprudence). Some jurisprudents' views on Velâyat-e Faqih differ from the popular view and sometimes opposing views are put forward in this respect. Ayatollah Khoei is one of the most prominent contemporary religious jurists who is propounded to have differing views on this subject. The question raised by this article is whether or not his objections to some of the arguments concerning Velâyat-e Faqih, and the textual arguments in particular represent his rejection of this idea. In answer to this question, the research discusses Ayatollah Khoei‟s objections to some arguments, using a descriptive-explanatory method; and then, making a critical analysis, the research points to some other questions in order to show that what is presented as his arguments against Velâyat-e Faqih is not a comprehensive coverage of his views in this regard, and the jurisdiction of Velâyat-e Faqih reflected in his view can be proved in other ways. Furthermore, in practice he was an advocate of Velâyat-e Faqih.

    The concept of the right to determine one‟s own future in international law has evolved since the 1950s; especially in relation to the right of sovereignty, territorial integrity, separation, independence and autonomy; and this evolution is still in effect. This study examines the evolution of the concept of the right to determine one‟s own future according to the judicial system of the International Court of Justice, including such cases like the colonization of South West Africa (present Namibia) (1949-1971), West Africa (1975), East Timor (1995), the construction of the retaining wall in occupied Palestine (2004) and the Declaration of Kosovo‟s Independence (2010). There has been a change in the meaning of the right to determine one‟s own future so that today the mere ability to accelerate the processes of decolonization refers to recognizing the right of the inhabitants of non-autonomous territories to be independent, the possibility of declaring unilateral independence and separation under certain conditions, holding a free and genuine referendum to gain this right, and identifying the commitment of third-party governments. However, the judges of the International Court of Justice have not yet taken advantage of the available opportunities to clarify the idea of determination of one‟s own future, given a definition of people (ethnicities) and the conditions which a government should have delineate the commitment of third-party governments and the position of the international law on unilateral declaration of independence and separation.

    Possessing divine spirit and reason, man is intrinsically and originally a creature that has dignity and free will; and these two are God-given favors which are equal rights of all people all over the world regardless of their race and color. Preference on the grounds of nationality, race, color, skin, fortune, wealth and social, family or national status, etc. is forbidden and contrary to the dignity which mankind has in essence. Using a descriptive-analytical method and attempting to examine and analyze the relationship between dignity and freedom both in Islam and liberalism, this essay answers the important question concerning the difference between the view of Islam and liberalism about dignity and its relationship with freedom. The research findings indicate that, emphasizing on intrinsic dignity and complete subject to freedom of man, liberalism suppresses any behavior or act that has limitation or subject to conditions, and considers that these two qualities (i.e. dignity and freedom) are never and in no way detachable from man, even if he commits the most awful crime, and also, his dignity knows no limitations, he has complete freedom of choice and none of his actions can strip him of intrinsic dignity. According to humanism, self-founded wisdom and complete freedom are the foundations of intrinsic dignity. As for the revealed school of Islam, in addition to its exposition of intrinsic dignity, pays attention to man‟s axiological dignity and his value-based freedom; i.e. it is by virtue of his struggle that man reaches this rank of dignity and thus providing the grounds for his growth and sublimity. This kind of dignity rests on solid foundations the most important of which are: the state of being object of angel‟s worship, Divine vicegerency, trustworthiness; God-given knowledge; having control over the existent, the state of being the noblest of all creation; having freedom and authority; piety as well as reason and divine fitra (innate nature).
