    علی رغم اصلاحات قانونی گسترده در قوانین مجازات اسلامی و آیین دادرسی کیفری مصوب 1392 پیرامون اطفال و نوجوانان، همچنان ایرادهایی در حوزه مسوولیت کیفری، نوع مجازات قابل اجرا و دادرسی جرایم ایشان وجود دارد. این مقاله با روش کتابخانه ای و پس از بررسی دقیق منابع فقهی و قانونی موجود به این نتیجه رسید که هر چند قوانین کشور ناظر به پذیرش نسبی سن مسوولیت کیفری اطفال و نوجونان در حوزه جرایم تعزیری و استفاده حداقلی از کیفر و افزایش وضع اقدامات تامینی و تربیتی است، لیکن سن مزبور به ویژه در مورد اجرای مجازات های حدی و قصاص فاقد انطباق با مقتضیات اجتماعی بوده و می توان با تفکیک میان سن عبادی و مسوولیت کیفری بر اساس منابع فقهی و علمی موجود، سن مسوولیت را به نحو مناسبی افزایش داد که این امر مشکل مربوط به اجرای کیفرهای مستوجب قصاص و حد را نیز در خصوص اطفال مرتفع خواهد ساخت.

    امروزه یکی از بارزترین نوع خشونت ها علیه کودکان در سراسر جهان، کودک آزاری جنسی است که نوعا بازتابی از علل آسیب های اجتماعی است. آداب و سنت های موجود در جامعه بعضا موجب پنهان ساختن موارد خشونت جنسی علیه کودکان می شود. بسیاری از موارد سوءاستفاده جنسی، به سبب پنهان کاری و ترس از برملاشدن، گزارش نشده و آثار مخرب آن بر کودکان مستور باقی می ماند. از آنجا که یکی از خطرناک ترین نوع خشونت علیه کودکان، آزار جنسی آنان است، بررسی عوامل هنجاری فرهنگی آن بسیار حایز اهمیت است و ما را در آسیب شناسی و ارایه راه کارهای مقتضی یاری می رساند. از این رو مقاله حاضر درصدد پاسخ به این سوال اصلی است که چه مسایل هنجاری فرهنگی می تواند موجب پنهان کاری موارد کودک آزاری جنسی شود و به تبع آن، خشونت جنسی علیه اطفال و نوجوانان را تسهیل سازد و موجب افزایش این گونه بزه کاری ها شود. درک ارزش هایی که عموما در بین مردمی با فرهنگی خاص وجود دارد، این امکان را به ما می دهد که موانع اجتماعی افشاگری آزار جنسی کودکان را از میان برداریم. به طور کلی در مقاله حاضر دریافته شد که اهم عوامل فرهنگی مذکور عبارتند از: آبرو و شرف خانوادگی، عفت و شرم، تبعیضات ناروای جنسیتی، هزینه های گزاف افشاگری، تفاوت فرهنگی و نژادپرستی، اعتقادات دینی انحرافی و عدم پایبندی موثر به ارزش های معقول فرهنگی.

    گستردگی مضامین حقوقی مطرح شده در پیمان نامه بین المللی حقوق کودک موجب ارتباط تنگاتنگ آن با نهادها و فعالیت های مختلف اجتماعی مرتبط با کودک شده است، از جمله مهم ترین نهاد یا فعالیت اجتماعی که اغلب کودکان تقریبا همه روزه با آن مواجهه متقابل دارند، آموزش و پرورش است که بررسی ارتباط آن با حقوق کودک اهمیت دارد. بر این اساس در مقاله حاضر، با مروری تحلیلی بر متون نظری و گزارش های پژوهشی موجود در ادبیات حوزه حقوق کودک، الگویی تفسیری از نسبت چندگانه بین نظام آموزش و پرورش و پیمان نامه حقوق کودک ارایه و دلالت هایی برای ارزیابی عملکرد مدرسه از چشم انداز حقوق کودک استنباط شده است. طبق نتایج این بررسی، بین آموزش و پرورش و حقوق کودک ارتباطی سه وجهی برقرار است: آموزش و پرورش حق کودک است؛ آموزش مدرسه ای ابزار تامین حقوق کودک است؛ آموزش و پرورش موضوع پایش حقوق کودک است. سومین وجه این ارتباط، تاکیدی است بر لزوم ارزیابی عملکرد مدرسه از چشم انداز حقوق کودک. از بین 41 ماده مربوط به حقوق کودک در پیمان نامه، حق مشارکت، عدم تبعیض، دفاع و دادرسی، حفاظت از خشونت، رعایت منافع عالیه، حریم خصوصی، آزادی بیان و امنیت، از جمله حقوق اساسی هستند که می توانند معیار ارزیابی عملکرد آموزش و پرورش و به طور خاص، مدرسه در رعایت حقوق کودک و عمل به پیمان نامه بین المللی باشند.

    حق حیات مهم ترین حق طبیعی هر انسانی به ویژه کودک است. این حق پایه و اساس تمام حقوق بشری به شمار می رود و هرگونه تعرض به آن نقض صریح و آشکار حقوق بنیادین بشر محسوب می گردد. بر اساس آموزه های اسلام و تصریح بسیاری از اسناد بین المللی، کودک به عنوان یک انسان حق دارد که حیات و زندگانی او تحت هر شرایطی به نحو شایسته ای تامین گردد. امروزه با درگیری های مسلحانه ای که استکبار جهانی برای دستیابی به منافع اقتصادی و سیاسی خود در برخی کشورها از جمله یمن به راه انداخته اند، حقوق مسلم کودکان از جمله حق حیات، حق بهداشت، حق تحصیل آنان، به طور آشکاری تهدید و نقض شده است و هر ساله هزاران کودک یمنی در اثر این درگیری ها جان خود را از دست می دهند. در پژوهش حاضر که با روش توصیفی تحلیلی و تطبیقی صورت گرفته، ضمن بررسی مبانی حق حیات کودک در اسلام و اسناد بین المللی و آثار مخاصمات مسلحانه بر حیات کودکان، حق حیات کودکان یمن مورد بحث و بررسی قرار گرفته و بیان گردیده است که بر همه افراد جامعه انسانی، نهادهای ملی و بین المللی و دولت ها لازم است که در حد توان، ساز و کارهای تامین این حق را فراهم کنند و از بروز خشونت علیه کودکان در مخاصمات مسلحانه جلوگیری کنند. علاوه بر این ضرورت دارد افرادی که حیات کودکان را در مخاصمات مسلحانه به خطر می اندازند، به اتهام جرایم جنگی، تعقیب، محاکمه و مجازات شوند.

    حق بر سلامت یکی از حقوق بنیادین انسان ها محسوب می شود. حق بر سلامت دهان و دندان که یکی از ابعاد این حق و بخش جدایی ناپذیر از سلامت عمومی می باشد، به وضعیت بدون بیماری و درد مزمن در ناحیه دهان، صورت و گلو اطلاق می شود. از میان گروه های انسانی، کودکان آسیب پذیرترین افراد هستند که عوامل مختلفی سلامت آن ها را تهدید می کند. از این رو اسناد بین المللی به ویژه «کنوانسیون حقوق کودک» (1989 م.) بر حق بر سلامت کودکان تاکید دارند. بیماری های دهان و دندان از جمله عواملی هستند که به طور جدی این حق را تحت تاثیر قرار می دهند. این بیماری ها تنها ایجاد درد نمی کنند، بلکه بر نحوه غذاخوردن، صحبت کردن، کیفیت زندگی، اعتماد به نفس درونی و اجتماعی کودک تاثیرگذار هستند. مقاله حاضر مبتنی بر یک روش توصیفی تحلیلی و با بررسی رویکرد حقوق بین الملل به حق بر سلامت و حق بر سلامت دهان و دندان و تبیین حقوق کودک در این حوزه، به این سوال پاسخ می دهد که در حال حاضر حق بر سلامت دهان و دندان کودکان در چه وضعیتی قرار دارد؟ این مقاله نتیجه می گیرد که علی رغم درک اهمیت ویژه سلامت دهان و دندان کودکان و حصول دستاوردهای مهم در این حوزه، همچنان بیماری های دهان و دندان در میان کودکان، به طور گسترده شیوع دارد و تحقق حق مذکور به شکل مطلوب، با موانع و محدودیت های فراوانی رو به رو است. ضروری است که علاوه بر نهادهای بین المللی، کشورها نیز همسو با برنامه های جهانی سلامتی برای همه، به صورت هدفمند و سازماندهی شده به ویژه در زمینه پیشگیری از این بیماری ها و بهبود دسترسی به مراقبت های بهداشتی اولیه اقدام نمایند. همچنین دسترسی به اطلاعات سلامت در تمام دنیا، بهره مندی از فناوری های جدید، ارایه گزارش های منظم و سالیانه توسط دولت ها در زمینه سلامتی دهان و دندان کودکان می تواند به ارتقای حق بر سلامت دهان و دندان کودکان کمک فراوانی نماید.

    کودک همسری یکی از چالش های اساسی در نهاد خانواده و در جامعه است. کودک همسری در طول تاریخ جوامع وجود داشته و بسته به مقتضیات زمانی و مکانی نیز وجود خواهد داشت، اما افزایش آن در جامعه به ویژه به دلایلی مانند فقر و وجود اختلاف فاحش سنی یک تهدیدی بر نهاد خانواده و جامعه تلقی می شود. در این نوشتار، آمار کودک همسری در کل کشور بر اساس سالنامه های آماری معتبر بررسی شده است. نتایج بررسی آماری نشان می دهد که روند کودک همسری از سال 1390 تا سال 1398 روند صعودی را طی کرده و استان های خراسان رضوی، آذربایجان شرقی، سیستان و بلوچستان و خوزستان تا سال 1396 در زمره استان هایی قرار دارد که بیشترین نرخ کودک همسری در آن ها اتفاق افتاده است. در این میان استان های یزد و سمنان کم ترین آمار را به خود اختصاص داده اند.
    استان آذربایجان شرقی در ازدواج زودهنگام و کودک همسری و همچنین در طلاق گروه سنی 10 تا 14 سال در رتبه دوم کشور قرار دارد. در داخل شهرستان های استان نیز کودک همسری در شهرستان های ملکان، بستان آباد، سراب و چاراویماق بیشتر رایج است و بالاترین درصد طلاق نیز در ازدواج های زودهنگام در شهرستان ورزقان، ملکان، سراب، خداآفرین، کلیبر و هشترود مشاهده شده است. بنابراین برای پیشگیری، تعدیل و کنترل کودک همسری های غیر منطقی و ناخواسته در جامعه و مدیریت صحیح خانواده های کودک همسر به نظر می رسد آموزش و ارتقای مهارت زندگی و ارتباطی خانواده های کودک همسر، آموزش و ارتقای آگاهی اقشار مختلف در خصوص پیامدهای کودک همسری، پیشگیری اجتماعی، قانونی و اقتصادی از وقوع کودک همسری با اختلاف فاحش سنی و کودک همسری به دلایل فقر اقتصادی خانواده، ایجاد بانک اطلاعاتی و رصد مسایل و مشکلات فرایند کودک همسری، استفاده از رهبران دینی و ایمه جماعات در تغییر باورهای کلیشه ای حاکم، ایجاد تکلیف قانونی برای گذاراندن دوره های آموزشی مهارت های زندگی و زناشویی، ممنوعیت فواصل سنی غیر طبیعی سن زوج و زوجه در ازدواج های زیر 14 سال و تشکیل کمیته های پزشکی، روان شناختی و اجتماعی و فرهنگی برای هدایت صحیح خانواده ها در مسیر ازدواج موفق از جمله راه کارهایی است که می توان نرخ کودک همسری های غیر طبیعی را کنترل و تعدیل نمود.

    اینستاگرام یکی از بسترهای رسانه های نوین است که امکان حضور کاربران، از جمله والدین و کودکان را در فضای مجازی فراهم کرده است. کودکان کار اینستاگرامی به پدیده ای نوظهور در فضای مجازی اشاره دارد که کودکان توسط والدینشان به خدمت گرفته می شوند تا از طریق به نمایش گذاشتن جنبه های مختلف حیات زیستی شان، سودآور باشند. در این بین، قدرت ارتباطی رسانه ها می تواند مفهوم کودکی را برساخت کرده و حق بر حیات کودکی را در راستای منافع شرکت های تجاری یا اقتصاد خانواده تضعیف کند. هدف این پژوهش شناسایی چیستی مفهوم «کودک کار اینستاگرامی» است و این که این مفهوم با چه مقوله هایی برساخت می شوند؟ به این منظور هشت صفحه اینستاگرامی اینفلوینسرهای کودک انتخاب شدند و پس از تحلیل محتوای کیفی این صفحات با استفاده از نرم افزار MAX QDA دریافتیم که بدن و تعاملات کودک در این صفحات به مثابه «عنصر نمایش»، «عنصر هویت دهنده و برندساز مادر»، «عرصه ای برای تبلیغات» و همچنین اطلاعات شخصی کودک به مثابه «عرصه ای برای ارضای حس کنجکاوی» مفاهیمی هستند که مفهوم کودک کار اینستاگرامی را برساخت می کنند تا از طریق جذب فالوورهای بیشتر، خانواده های آنان بتوانند سود بیشتری از شرکت های تبلیغاتی کسب کنند.

    افزایش تجربه ها و پیشرفت های بشر، تاثیر مستقیم در تحولات اجتماعی و حقوقی داشته است. به عنوان نمونه، دیگر امروزه حق های سنتی مانند حق حیات و حق بر امنیت تن، در شمار بدیهیات شمرده می شوند و حق های کم تر شناخته شده ای وارد گفتمان حقوق داخلی و بین المللی شده اند. حق شادی با تاکید بر «حق شادی کودکان» به عنوان یکی از این حق های نسبتا نوظهور وارد ادبیات حقوق بین الملل و حقوق داخلی برخی کشورها شده است تا جایی که بعضا به عنوان یکی از شاخص های توسعه یافتگی کشورها قلمداد می شود. نویسندگان مقاله، با شیوه گردآوری اطلاعات به طریق کتابخانه ای و بررسی داده ها به شیوه توصیفی تحلیلی و تطبیقی با تبیین مفهوم شادی در فلسفه، عرفان، اخلاق، ادبیات و فقه در تلاش هستند تا «هست ها» و «بایدها» در حوزه حق شادی کودکان را بررسی نمایند. آنچه محصل شده است این که نهادهای مردم نهاد (جامعه مدنی) و سازمان های دولتی مانند وزارت آموزش و پرورش و کانون پرورش فکری کودکان و نوجوانان، هنوز با وجود ارجگذاری به برخی دستاوردهای مثبت آن ها، به دلایلی از جمله کم تر شناخته بودن این حق، عدم اولویت این حق نزد سیاستمداران، فقدان هماهنگی میان سیاست ها و مدیران و در نهایت، برخی مشکلات در ساختار فرهنگی و اقتصادی، از رسالت حقیقی خود فاصله دارند که ضمن شناسایی و معرفی برخی از مهم ترین کاستی ها و چالش ها، به ارایه پیشنهادات متناسب با آن ها مبادرت شده است.

    حقوق کودک، به عنوان بخشی از مباحث حقوق بشر، بر حمایت و پشتیبانی از کودکان و دستیابی آنان به حقوق اساسی خویش اهتمام دارد. حقوق بشر، حقوق ذاتی همه انسان ها می باشد. کودکان نیز به طور یکسان و بدون تبعیض صاحب این حقوق هستند. هدف اصلی این پژوهش بررسی حق بر آموزش کودکان و بررسی آن در اسناد بین المللی است. برای دستیابی به این هدف از روش تحلیلی بهره گرفته شده است. مبنای اصلی این تحلیل، کنوانسیون حقوق کودک به عنوان مهم ترین سند خاص در حوزه حقوق کودک، بندهای مرتبط این کنوانسیون در ارتباط با حق آموزش کودک، دیگر اسناد بین المللی حقوق بشر، جایگاه آموزش در نظام حقوق بشر بین الملل، اعلامیه حقوق بشر و اعلامیه حقوق بشر اسلامی می باشد، لذا به رسمیت شناختن حق بر آموزش کودکان در نظام حقوق بشر، لزوم حمایت و تعهد دولت ها در دسترسی کودکان به امکانات آموزشی مناسب را در پی خواهد داشت. اعلامیه حقوق کودک دربردارنده مفهوم گسترده ای از کودک به عنوان صاحبان حق می باشد. چهار اصل اساسی کنوانسیون حقوق کودک را می توان: 1 اصل عدم تبعیض و تضمین حقوق مندرج در کنوانسیون برای همه کودکان، بدون هر نوع تبعیض؛ 2 در اولویت قرارگرفتن منافع و علایق کودک در هر قانون و مقرراتی که بر کودک تاثیر می گذارد؛ 3 حق زندگی، بقا و رشد کودکان و نوجوانان؛ 4 حق ارایه نظر و عقیده کودکان در کلیه مراحل تصمیم گیری که به آن ها مربوط می شود. این سند بین المللی، ضمن مواد 28 و 29 حق آموزش را در کودکان به رسمیت می شناسد و این حق بر اساس فرصت های برابر تبیین شده است. از دیگر اسناد بین المللی حقوق بشر، اعلامیه حقوق بشر 1948 می باشد. ماده 26 آن، حق بر آموزش کودکان را به رسمیت می شناسد. همچنین آموزش را هدایت شخصیت انسانی با حسن تفاهم، گذشت و احترام به عقاید مختلف می داند. این تحلیل، از یکسو، معرف اعتقاد به کرامت ذاتی کودکان و قایل شدن «شخصیت انسانی»، بدون هرگونه تبعیض بر محوریت موضوعات؛ جنسیت، رنگ، عقیده، قومیت و مذهب و سایر ویژگی ها می باشد؛ از سوی دیگر، تاکید بر اصل حمایت از کودکان و شناسایی حقوق بنیادین آن ها می باشد. حق بر آموزش به عنوان یک اصل حقوق بشر، در حوزه کودکان شامل حقوقی، از جمله حق دسترسی به امکانات آموزشی، حق برخورداری از آموزش با کیفیت و استاندارد، احترام به شان و منزلت انسانی کودک، آموزش بدون تبعیض در تمام مراحل دوران کودکی، در دسترس بودن امکانات آموزشی و برابری فرصت ها در آموزش می باشد.

    Despite widespread legal reforms in the Islamic Penal Code and the code of penal procedure approved in 1392, in the scope of children and adolescents, there are still gaps and bugs in the Criminal liability of the child, the kind of executable punishment against them and procedure of crimes of children. This article, in a library method and after accurate study of existing jurisprudence and legal sources, concluded that, although existing laws regulate the relative acceptance of the age of criminal liability of children and adolescents in the field of crimes of inferiority and the minimum use of punishment and increase in legislating educative acts ,but the age of criminal liability Especially regarding the execution of hodoud and retribution is considered to face the challenge of aberration with social requirements and can be increased by appropriate separation between age of religious responsibility and criminal liability, based on available jurisprudential and scientific sources, which is a problem related to the execution of retributive punishments and it will raise the limit for children too.

    Nowadays, one of the most known types of violence against children around the world is child sexual abuse, which is typically a reflection of the causes of social problem. The customs and traditions of society sometimes make the people to conceal sexual violence against children. Many cases of sexual abuse have not been reported due to concealment and fear of being exposed, and its deleterious effects on children remain concealed. As one of the most dangerous forms of violence against children is their sexual abuse, it is important to examine cultural normative factors and can help us in pathology and in providing appropriate solutions. Therefore, the present article seeks to answer the key question of what cultural norms can make us to conceal child sexual abuse cases and consequently facilitate and increase sexual violence against children and adolescents. Understanding the values generally held by people of a particular culture allows us to eliminate the social barriers to disclosing child sexual abuse. Overall, this article found that the important cultural factors are: family honor and dignity, chastity, gender discrimination, high costs of disclosure, traditional and racial difference, deviant religious beliefs and noneffective adherence to reasonable cultural norms.

    The wide range of legal implications of the International Convention on the Rights of the Child (CRC) have made it closely linked to various child-related social institutions and activities. One of the most important institutions or social activities that most children are exposed to on a daily basis is education, which is important in examining its relationship to children's rights. Accordingly, this paper presents an interpretative model of the multiple relationship between the education system and CRC with an overview of theoretical texts and research reports in the literature on child rights and implications for evaluating school performance from the child rights perspective. According to the results of this study, there is a three-way relationship between education and children's rights: education is a child's right; school is a tool for observing children's rights; and education is a subject of children's rights monitoring. The third aspect of this relationship emphasizes the need to evaluate school performance from a child rights perspective. Among the 41 articles on CRC, the right to participate, non-discrimination, defense and litigation, protection of violence, the best interests, privacy, freedom of expression, and security are fundamental rights that can be used as criteria for assessing The school's performance is in observance of children's rights and in compliance with CRC.

    The right to life is the most important right of any human being, especially the child. This right is the cornerstone of all human rights and any violation of it is a gross and grave violation of fundamental human rights. According to the teachings of Islam and many International Instruments, the child, as a human being, has the right to a decent living and life under any circumstances. Today, with armed clashes waged by global arrogance to achieve their economic and political interests in some countries, including Yemen, the inherent rights of children, including the right to life, the right to health, the right to education, have been clearly threatened and violated and every year thousands of Yemeni children die as a result of these clashes. Theis study is a descriptive-analytical and comparative study that examine the fundamentals of the right to life of child in Islam and international Instruments and the effects of armed conflict on child rights. In addition, the right to life of children in Yemen has been discussed and stated that it is essential for all people, national and international institutions and governments to provide mechanisms to secure this right and prevent violence against children in armed conflict. In addition, it is imperative that those who endanger the life of children in armed conflict be charged with war crimes, prosecution, trial and punishment.

    Health is one of the most important human rights. The right to oral health is one aspect of this right and an integral part of public health pertains to the disease-free status and chronic pain in the mouth, face and throat. Among the human groups, children are the most vulnerable to various health threats, and therefore international instruments, in particular the Convention on the Rights of the Child (1989), emphasize the right to children's health. Oral diseases are among the factors that seriously affect this right. These diseases not only cause pain, but also affect the eating, speaking and quality of life, inner and social self-esteem of the child. Based on a descriptive-analytical approach and in the light of an overview of the international law approach to the right to health and the right to oral health and the explanation of children's rights in this field, the present paper addresses the question of the right to oral health and what is the position of child in oral health? This paper concludes that, despite the particular importance of children's oral health and the achievement of important results in this area, Oral diseases continue to be widespread among children and the right to do so is faced with many obstacles and limitations. In addition to international institutions, it is essential that states, along with global health programs for all, are targeted and organized, in particular to prevent these diseases and improve access to primary health care. Access to health information around the world, the use of new technologies, regular and annual reports by states on children's oral health can help promote the right to children's oral health.

    Child marriage is one of the major challenges in the family institution and in society. Child marriage has been widespread throughout the history of societies depend on time and place. But its increase in society, especially for reasons such as poverty and the widespread age difference is considered a threat to the institution of the family and society. In this article, child marriages across the country are reviewed based on valid statistical yearbooks. The results of statistical analysis show that the trend of child marriage has been increasing since 2011 until 2019 and Khorasan-e-Razavi, East Azarbaijan, Sistan and Baluchestan and Khuzestan provinces are among the provinces with the highest rates of child marriage. Yazd and Semnan provinces have the least statistics. East Azarbaijan province ranks second in early marriage and child marriage as well as in divorce in the age group of 10 to 14 years. Within the provinces, child marriage is more common in the cities of Malekan, Bostanabad, Sarab and Charoimagh and the highest divorce rate was observed in early marriages in Varzaghan, Malekan, Sarab, Khodafarin, Kaleibar and Hashtrood. Therefore, for preventing, adjustment and controlling of unintended and unwanted child marriage in the community and proper management of families with child marriage, it seems that education and promotion of life skills and communication of child marriage families, education and awareness of different groups of people about child marriage outcomes, Social, Legal and Economic Prevention of child marriage based on economic poverty, creation of a database and observation of issues and problems of child marriage, employing religious leaders and community Imams in changing the stereotypes , Creating a legal obligation to deliver courses Life and marital harassment, banning abnormal age at marriage and marrying under 14, and forming medical, psychological, social, and cultural committees to guide families on the path to successful marriage are the ways in which the abnormal childmarriage rate can be decreased, Controlled and modified.

    Instagram is considered a new medium context where users involving parents and children are able to actively act. Instagram Child Labor is a new phenomenon on cyberspace where children are exploited by their parents to be of use by expressing various aspects of their biological life. With this in mind, media power is capable of creating a concept of child as well as behaving to the detriment of children in favor of businesses and family wealth. This study aims at identifying the meaning of "Instagram Child Labor" and what it collocates with. To this purpose, eight influencer pages working on children scope were picked out to be analyzed qualitatively utilizing MAX QDA. The results indicate that children’s body and communications equal to "display means", "mothers’ identity and brand maker", "a means to advertise" and moreover, children’s personal information is akin to "a way to satisfy children’s curiosity" that with the prior one create the concept of Instagram Child Labor so that families become more lucrative by helping advertising firms make more followers.

    The increased human beings experiences and improvements have direct effect on social and legal developments. As a sample, the classic rights such as the right to life and the right to body immunity are counted as obvious and normal rights. The less-known rights have been appeared in both internal and international law. The right to happiness with emphasis on child happiness is one of these new phenomenons. This right obtains its situation as a new generation of developing factors by some countries. The authors search and explain by library-based studying method on the concept of happiness in philosophy, theosophy, morality, literature and religious jurisprudence. Then, (facts) and (norms) about joining of children happiness and legal system are discovered. The results show us non-governmental organizations and governmental ones such as teaching and cultivation ministry or Institute for the intellectual development of children and young adults in spite of their advantageous services are far from their real missions. It may because of no priority of happiness for politicians, absence of consistency between policy and relative administrators, some cultural and economic challenges, etc. This article has submitted some suggestion to solve the obstacles in accordance with available circumstances.

    Children's rights, as part of the human rights debate, focus on protecting and supporting children and achieving their basic rights. Human rights are the inherent rights of all human beings. Children also have the same rights without discrimination. The main purpose of this research is to investigate the right to education of children and to study it in international documents. An analytical approach has been used to achieve this goal. The main focus of this analysis is the Convention on the Rights of the Child as the most important document in the field of child rights, related articles on the Child’s education right, other international human rights instruments, the position of education in the international human rights system, the Declaration of Human Rights and Islamic Declaration of Human Rights. Therefore, recognizing the right to education for children in the human rights system will require the support and commitment of governments to provide children with access to appropriate educational facilities. The Declaration of the Rights of the Child incorporates the broad concept of the child as the right holder. The four basic principles of the Convention on the Rights of the Child can be: 1. The principle of non-discrimination and the guarantee of the rights of the Convention for all children without any discrimination; 2. The priority of the interests of the child in any law and regulations affecting the child; 3. The right to life, survival and development of children and adolescents; 4. The right to have children's views and opinions at all stages of their decision-making. In this international instrument, Articles 28 and 29 recognize the right to education in children and this right has been enshrined in equal opportunities. Another international human rights instrument, especially in the field of children and the right to education of children, is the Human Rights Declaration of 1948. Article 26 recognizes the right to education of children and everyone has the right to equal access to education and access. It also sees education as guiding the human personality with good understanding, forgiveness and respect for different beliefs. This analysis, on the one hand, represents the belief in the inherent dignity of children and the "human personality" without any discrimination on the basis of issues of gender, color, opinion, ethnicity and religion, and on the other hand, emphasizes the principle is to protect children and to recognize their fundamental rights. The right to education as a human rights principle in the field of children, including the right to access to education, the right to quality and standard education, respect for the human dignity and dignity of the child, nondiscrimination education at all stages of childhood, access to educational opportunities and equality of opportunity in education.
