    حقوق شهروندی از جمله مفاهیمی است که دربردارنده حقوق و تکالیف متقابل شهروندان و حکومت در قبال یکدیگر است. وقوع هر انقلابی باعث ایجاد تحول های بنیادین در بنیان های نظری و عملی آن کشور می شود. به دنبال وقوع انقلاب مشروطه، در متمم قانون اساسی مشروطه، فصلی تحت عنوان حقوق ملت به رسمیت شناخته شد لکن به شکل جامع و مانعی به برخی از موضوعات از جمله حقوق شهروندی زنان نپرداخته بود. اما به دنبال پیروزی انقلاب اسلامی مردم ایران و استقرار حکومت جمهوری اسلامی و تعیین قانون اساسی، فصل سوم این قانون با نام حقوق ملت به تبیین حقوق شهروندی مردم ایران اختصاص یافت و به میزان قابل توجهی نسبت به قانون اساسی مشروطه و متمم آن، حقوق شهروندی مردم را به رسمیت شناخت. پژوهش و تحقیق حاضر با روش تحلیلی تطبیقی به بررسی تاثیر انقلاب اسلامی در تامین و تضمین حقوق شهروندی مردم ایران در مقایسه با قانون اساسی مشروطه و متمم آن و ذکر برخی از مصادیق این تاثیر پرداخته است.

    این مقاله به تحول مفهوم آزادی های عمومی بعد از انقلاب اسلامی در مقایسه تطبیقی با قبل از آن و دوران شاهنشاهی می پردازد. سوال اصلی اینست که آیا اساسا تحولی در این مفهوم بعد از انقلاب اسلامی واقع شده است؟ و اگر آری؛ این تحول چه بوده و کدام عوامل و تغییرات نظری و عملی سبب این تحول و تغییر بوده است؟ روش ما در این پژوهش، روش توصیفی - تحلیلی است؛ به این نحو که مفهوم آزادی های عمومی را از منبع اصلی دانش حقوق یعنی قانون اساسی قبل و بعد انقلاب اسلامی استخراج و توصیف کرده و ویژگی های آن را در رویکردی تطبیقی نسبت به قبل و بعد از انقلاب اسلامی مورد تحلیل و بررسی قرار می دهیم. نتایج حاصل از این پژوهش نشان می دهد که با پیروزی انقلاب اسلامی؛ توجه به نگرش رهبران و واضعان قانون اساسی به مفاهیم بنیادین انسانی و حقوقی از جمله آزادی در بعد نظری، و شکل گیری و تحول نهادها و ساختار حکومت بعد از انقلاب اسلامی در بعد عملی؛ معرف تحول عمیق، وسیع و مثبت مفهوم آزادی های عمومی در نظام اسلامی و قانون اساسی جمهوری اسلامی بوده است که نمود آن خصوصا در فصل حقوق ملت مشهود است.

    پوشش زنان همواره از آن دسته از مسایل بحث برانگیز جامعه امروز بوده است. اسلام در راستای سعادت فردی و جمعی انسان ها اقدام به صدور احکامی از جمله حجاب نموده است. حجاب شرعی زنان در اسلام برای برخی افراد قابل هضم نیست و به همین دلیل به مخالفت با آن می پردازند. این پژوهش در نظر دارد تا موضوع پوشش زنان را در ارتباط با مفاهیمی همچون حقوق بشر و حقوق شهروندی در جامعه ایران اسلامی بررسی نماید و به این پرسش مهم پاسخ دهد، آیا حجاب در تقابل با حقوق شهروندی و یا حقوق بشر است؟ و یا جزیی از آنها محسوب می شود؟ بررسی دیدگاه های اصالت فرد و اصالت جامعه نیز در ارتباط با حجاب مورد واکاوی قرار گرفته است و به تکمیل بحث کمک می کند. ارتباط حجاب و فضای مجازی نیز از مسایل به روز و مبتلابه جوامع است که بررسی آن نیز در این پژوهش به صورت مختصر مدنظر قرار گرفته است.روش این مقاله توصیفی-کتابخانه ای است.

    مردم دارای جایگاهی حساس و تعیین کننده در حکومت اند. به طوری که اگر حکومتی نتواند اقبال مردمی را حفظ کند، محکوم به فناست. نظام مردم سالاری دینی با قبول قدرت مردم در اداره ی امور کشور، جایگزین نظام های استبدادی و خودکامه شده است. در حکومت های استبدادی، اداره ی امور کشور مردمی نیست، بلکه مبتنی بر بوروکراسی است. بوروکراسی مهم ترین عنصر انجام فعالیت در حکومت استبدادی است. بدین ترتیب، نمی توان بوروکراسی را متناسب با نظام مردم سالاری دینی دانست. سوال این پژوهش آن است که جایگزین بوروکراسی در نظام مردم سالاری دینی چیست؟ البته پاسخ این سوال ناظر به کوتاه مدت نیست، بلکه در بلند مدت و تدریجا محقق خواهد شد. در این پژوهش از روش توصیفی-تحلیلی استفاده شده است و گردآوری اطلاعات کتابخانه ای است. آن چه نتیجه ی این تحقیق بدان اشاره می کند، عطف توجه به سازمان ها و تشکل های مردم نهاد است. تشکل های مردم نهاد استعداد آن را دارند که در آینده، به عنوان جایگزین بوروکراسی مطرح شده و انجام فعالیت، خدمات رسانی و به طور کل، اداره ی امور کشور را بر عهده گیرند. البته این امر، مستلزم رفع نواقص مردم نهادها و گسترش و تقویت آن ها است. لکن با استقرار تشکل های مردم نهاد، کارآمدی حکومت مبتنی بر مردم سالاری دینی افزایشی چشم گیر خواهد یافت و حقوق شهروندی با ضمانت اجرای کامل تری همراه خواهد شد.

    حاکمیت یکی از بنیادین ترین مفاهیم حقوق عمومی و علوم سیاسی است که هر تغییری در این مفهوم کل حقوق عمومی و علوم سیاسی و روابط قدرت با مردم را تحت تاثیر قرار می دهد. شهروندی-و به تبع حقوق شهروندی- نیز بیان یک وضعیتی است که در آن به دلیل ارتباط فرد با حاکمیت، حقوق و تکالیفی برای فرد ایجاد می شود. فلذا تحقق حاکمیت -در یک وحدت مفهومی- لازمه ی تحقق حقوق شهروندی است. برای بحث از امکان حقوق شهروندی، پرسیده شد که «آیا حاکمیت در معنای مدرن آن-که به مثابه ی یک پدیدارحقوقی و تاریخی است- در ایران معاصر تحقق یافته است؟». آنچه محصول این تحقیق بود این است که مفهوم حاکمیت در ایران مدرن همواره مفهومی چند پاره بوده و هرگز نتوانسته به یک وحدت در توضیح خود برسد. این چندپارگی محصول تلاش نیروهای متضاد در اعصار مختلف و تاثیرگذاری آنها در شکل گیری این مفهوم در نظام حقوقی ایران بوده و هست . تحقیق حاضر با بررسی دکترین های حقوقی و اقوال جریان های متضاد با روش استنباطی و تفسیری و استدلالی به صورت اسنادی و رجوع به متن حقوقدانان و تقریر نظریاتشان، سعی در صورتبندی نظری پدیدار حاکمیت داشت برای نشان دادن این چند پارگی.

    citizenship rights are among the concepts which include the rights and obligations of citizens and the government towards each other. the occurrence of any revolution creates fundamental changes in theoretical and practical bases of the country. Following the constitutional revolution, the amendment of the constitutionalism era’s constitution was recognized as the rights of the nation, but had not raised a comprehensive view of some issues, including women's citizenship rights. but after the victory of the islamic revolution of iran and establishment of islamic republic and constitution determination, the third chapter of this law was devoted to the declaration of citizen rights of the people of iran, which significantly recognized the constitutional rights of the people. this study examines the influence of islamic revolution in the supply and guarantees of citizenship rights of iranian people in comparison to constitutionalism era’s constitution and the Amendment of it and some examples of this effect

    This article deals with the evolution of the concept of public freedoms after the Islamic Revolution in a comparative comparison with before and during the imperial period. The main question is whether there has been a fundamental change in this concept after the Islamic Revolution? And if yes, What was this change? And what factors and theoretical and practical changes have caused this change? Our method in this research is descriptive-analytical method; In such a way that the concept of public freedoms from the main source of legal knowledge that is, the constitution was extracted and described before and after the Islamic Revolution and its characteristics in a comparative approach to before and after the Islamic Revolution we analyze and study. The results of this study show that with the victory of the Islamic Revolution; Paying attention to the attitude of the leaders and legislator of the constitution to basic human and legal concepts including freedom in the theoretical dimension, and the formation and evolution of institutions and the structure of government after the Islamic Revolution in the practical dimension it represents the deep, wide and positive evolution of the concept of public freedoms in the Islamic system and the constitution of the Islamic Republic its manifestation is especially evident in the chapter on the rights of the nation.

    Women's clothing has always been one of the most controversial issues in today's society. Islam has issued rulings such as hijab for the individual and collective well-being of human beings. The religious hijab of women in Islam is not digestible for some people and for this reason they oppose it. This study intends to examine the issue of women's clothing in relation to concepts such as human rights and citizenship rights in Islamic Iranian society and answer this important question, is the hijab in conflict with citizenship rights or human rights? Or is it a part of them? Examining the views of the originality of the individual and the originality of society in relation to the hijab has also been explored and helps to complete the discussion. The relationship between hijab and cyberspace is also an up-to-date issue in societies, the study of which has been briefly considered in this study.The method of this article is descriptive-library.

    The people have, in government, a prominent and decisive position. So that if a government cannot maintain the Popular acceptance, it is doomed. Religious democracy has replaced authoritarian regimes and dictatorships by accepting the power of the people to run the country. The administration of the country, in authoritarian regimes, is not popular, but is based on bureaucracy. The most important element in the running of an authoritarian government is the bureaucracy. Thus, bureaucracy cannot be considered compatible with a religious democracy. The question of this research is what is the alternative to bureaucracy in the system of religious democracy? Of course, the answer to this question is not short-term, but will be realized in the long run and gradually. In this research, descriptive-analytical method has been used. The method of collecting information is based on library. What the results of this study indicate is the focus on NGOs. They have the potential to emerge, in the future, as alternatives to the bureaucracy and to take, in general, over the activities, services and administration of the country. Of course, this requires eliminating the shortcomings of NGOs and expanding and strengthening them. However, the efficiency of government based on religious democracy will increase significantly, with the establishment of NGOs. Citizenship rights will also be accompanied by a fuller guarantee of implementation.

    Sovereignty is one of the most fundamental concepts of public law and politics, and any change in it affects the whole of public law and politics and the relationship of power with people. Citizenship- and citizenship rights - is also the expression of a situation in which, due to the individual's relationship with the sovereignty, rights and obligations are created for the individual. The question of the present inquiry was "Study of the concept of sovereignty as a legal-historical phenomenon beyond the two MASHROOTEH and the Islamic revolution."in order to find out what concept has been realized as sovereignty after two revolution (MASHROOTEH revolution and Islamic revolution).The result and outcome of this inquiry was that the concept of sovereignty in modern Iran always has been a fragmented and has never been able to be a unit to explanation itself. This fragmentation was/ is the result of the efforts of opposed forces -in different eras- and their influence in the formation of this concept in the Iranian legal system.The present inquiry has clarified the historical phenomenon of sovereignty by examining the legal doctrines and statements of opposed currents with the method of inferential, interpretive and reasoning, in the form of documents, and referring to the text of lawyers and expressing their theories. The present inquiry has tried to formulate the phenomenon of sovereignty to prove this fragmentation.
