Rational defense of women s rights in Islam

Abstract:
This article begins with a short introduction concerning the importance of Islamic legal disputes and especially women's rights as the most important subject under discussion between Islamic and modern thoughts. After this preface, he reports the history of feminism in western countries briefly familiarizing his readers with the basis of men's ideas about women and the circulation of its changes. Then he continues the main subject through stating some opinions to justify Islamic laws such as polygamy for men, inheritance, blood money, alimony, and the dowry for women rationally. Then, before expressing his own ideas, he tries to provide a rational framework to defend legal laws. He draws this conclusion that: "those laws are defensible which are in accordance with their true subjects in the world and legislated to attain their desirable gals. At first, he considers the law of polygamy. In his opinion (an undeniable truth) that leads us to the priority of polygamy over monogamy law, is the failure of monogamy to regulate the sexual relationship between two opposite sexes in the modern era. Practical and sociological analysis of this unpleasant reality shows that men have more desire than women. These differences should not be ignored by the law of marriage. Thus, the law of polygamy is rationally explained through these sexual differences. He explains it rationally. The writer concludes that - by the separation of morality and rights and the emphasis on their distinction – the law of polygamy is superior rightfully but monogamy is more favorable morally. In order to rationalize the laws of women's inheritance and blood money", he relies on some obvious preface and believes that it's natural for human beings to have a family and to sustain its physical and psychological health.The writer believes that women play the main role in the family safeguarding it with their talents and emotions. By the same token, they should be at home more than men. Therefore, Islam has legislated two various kinds of laws to protect men and women's financial rights:1- Alimony and the dowry for women because they dont work outside 2- Women's blood money and inheritance for men because they have to work for a living with difficulty.
