Jurisprudential Foundations of Prohibition of Organized Crimes: Types of Punishments

Abstract:
Organized crime are terms which categorize transnational, national, or local groupings of highly centralized enterprises run by criminals, who intend to engage in illegal activity, most commonly for monetary profit. They include smuggling drugs, trafficking of women and children for prostitution, money laundering, and theft of cultural and historical relics. Manifestations of such crimes are mainly considered to be amongst the new issues discussed in jurisprudence and legal theories. The jurisprudential rules and penal law (punishments) are regarded as the basis for considering these activities as crimes as well as deterrents, albeit with spiritual sanctions.
According jurisprudential foundations and sources, describing the manifestations of these crimes as prohibited and forbidden, could take place and be ascertained on priority basis. All related transactions and financial transfers by this way are invalid and any kind of appropriation of goods is unlawful. Depending on each case and instance of crime, the perpetrators are punishable on account of spreading corruption on earth [ifsad fil ardh].
