Exploring the criteria for defining three concepts of Dar-ol-Islam, Dar-ol-Kofr and Dar-ol-Harb and its adaptation with the present conditions in the international system

Abstract:
In this article, the views of Shia`Fogaha in 4 periods including Pre-Safavieh, Safavieh, Constitutional Revolution ( Mashrutah), and Islamic Revolution in regard to the criterion for defining Dar-ol-Islam, Dar-ol-Kofr and Dar-ol-Harb, as the three basic concepts in International RelationsFeghh,( 3 or 4 Faghih in each period) were explored. We could finally recognize three category of views:1-Those who believe the criterion for defining Dar-ol-Islam and Dar-ol-Kofr is applying or neglecting Islamic rules or Sharia,(ShahidAval)
2-Those who believe the criterion is the majority of population, being muslim or non-muslim, ( Ayat-ol-lahMontazeri)
3-Those who believe the criterion is the form of government, being Islamic or non islamic, ( SheikhToosi, AllamehHelli, Imam Khomeini .)
It was also clear that most offogaha during mashrutah and Islamic revolution era, believe in the third criterion, means the form of the government. This criterion is more adaptable with the present conditions in the international system and international relations which is based on nation- state countries. Thus, we can say that in International Relations`Feghh, the third criterion has more proponents and also is more adaptable with the current realities in international relations, to the extent that it can explain the cooperation and relationship in between the Islamic states and with non-Islamic states.
