Abstract:

In order to achieve its goal in protecting humanity in the course of an armed conflict and reducing human suffering, international humanitarian law (IHL) has sought from the very beginning of its development to be recognized as an impartial and universal body of law. However, some intellectual trends and some national, ethnic or religious cultures resist the ideal of globalization and universalization of humanitarian law. By analyzing the nature and causes of these oppositions, this article after reviewing excising trends seeks to find a solution for reconciliation of IHL with them and to recognize the cultural grounds for its universal dissemination.
