Abstract:

In the Islamic penal system, Islamic penalties refer to punishments that specify the type, amount, cause and quality of their execution in the Shari'ah, and include punishments, qisas, diat and ta'zir.
Among the controversial issues in the scholarly circles that have been mocked by the great religious authorities is whether, in spite of the legality of the religious minorities' blood money, it is practically possible to change the amount of blood money according to a particular state ruling. Religious minorities?
The results of this descriptive-analytical study indicate that religiously the amount of religious minorities can be changed according to the state order. In this way, although the primary requirement is non-approval of a government order, it is possible and provable to issue a government decree if it is in compliance with the objectives and purposes of the Shari'a, the prominence of the important, the certainty and respect of the public interest. The Islamic ruler has the power to change the amount of blood money for religious minorities
