Examples of Patients' Rights in the Light of the Normative Hierarchy of International Law

Abstract:
Background and Aim

The Right to Health as an Example of Human Rights Entered the International Law Literature as a General Principle After the Adoption of the Universal Declaration of Human Rights and the Covenant on Economic, Social and Cultural Rights. This Principle has Developed Over the Years in Terms of Instances, and From Within it Have Emerged Instances That are Closely Related to the Condition of Patients.

Materials and Methods

This Research is of Theoretical Type and the Research Method is Descriptive-Analytical and the Method of Data Collection is Library and has Been Done by Referring to Documents, Books and Articles.

Findings

The Status of Patients and Their Treatment Process is one of the Most Important Issues in the Field of Health Rights as one of the Examples of International Human Rights. On the Other Hand, the Set of Human Rights Norms is Closely and Interconnected; In Other Words, Violation of any of These Norms Leads to Indirect Violation of Other Norms.

Ethical Considerations:

 In Order to Organize this Research, While Observing the Authenticity of the Texts, Honesty and Fidelity Have Been Observed.

Conclusion

To Determine the Status of Instances of Patientschr('39') Rights, We Must Consider Two Specific Criteria: The First is the Relationship Between These Rights and the Rules of International Law and the Second is the Criterion of "Dependence or Non-Dependence on Resources". Among the Various Instances of Patientschr('39') Rights, Some of These Instances are in Fact Regarded as Examples of the Peremptory Norms of International Law. Other Examples of Patientschr('39') Rights are not Considered as a Peremptory Norm, But it Should not be Overlooked That These Cases Have Very Little Dependence on the Financial Resources to Provide and Guarantee Them. It Seems That This Category of Patients chr('39')Rights Also Has the Capacity to Become an Example of the Peremptory Norms in the International Human Rights Environment, and in Particular Patientschr('39') Rights.
