The right to health from the perspective of international treaties with emphasis on COVID-19 disease

Abstract:
Background and Aim

Due to the prevalence of coronavirus and the emergence of diseases and other diseases that can spread internationally, it poses serious risks to human health. So that today no country is safe from the damage of these diseases. The existence of this crisis calls on the countries to take extraordinary measures to protect the health and well-being of the people. But these measures must be in accordance with the law, even in cases of public emergency. The provisions of the Human Rights and the Political Covenant clarify the role of governments, which this article examines the right of the people to access health care and the health right, as well as the government's actions in creating social restrictions in the event of conflict with human rights regulations.

Materials and Methods

This Research is of Theoretical Type and the Research Method is Descriptive-Analytical and the Method of Data Collection is Library and has Been Done by Referring to Documents, Books and Articles.

Results

The right to health and the process of providing it in society is an allegory of human rights and governments are obliged to provide it in accordance with international standards. So the outbreak of coronavirus (19-COVID) has forced governments to take restrictive measures, but these restrictions must be in accordance with the law.Ethical considerations: In Order to Organize this Research, While Observing the Authenticity of the Texts, Honesty and Fidelity Have Been Observed.

Conclusion

The result shows that in accordance with international regulations on the right to health, the provision of the right to health is an inherent human right and in the case of occurrence of a crisis, the government is not plenipotentiary to deal with it and create social restrictions. These restrictions should be appropriate, limited and according to the law.
