Abstract:

In our country, the general policies of Article 44 of the Constitution and the Law on the Implementation of this Principle have been approved by the Expediency Council and the Islamic Consultative Assembly to implement the privatization program and are being implemented. Achieving private goals۔ Privatization is not provided for in these laws and in the process of privatization, economic corruption, and sometimes we are witnessing the loss and desire of government property during the transfers. It seems that the solution to some of these economic problems is the adoption of legislative, judicial and executive strategies in support of the economic system, while it seems that many of these behaviors can be assigned with the same civil responses, compensation and disciplinary punishment. Now, in the form of criminalization of behaviors, although many procedures have been criminalized contrary to the principles and rules of business, but the dispersion of laws and the lack of a comprehensive law on criminalization are among the main drawbacks of this criminal control.
