Components of differentiation of proceedings in the realm of crimes against security
In security-oriented criminal policy, it is a kind of indication of the conflict between two rights, namely the right of the individual and society to security against criminals and the right of the individual to have security against police-judicial agents and institutions. The focus is on community security. In fact, this kind of approach deprives people of many of the rights that were given to members of society under normal criminal policy. Hence the differential criminal procedure in crimes against security; It is handled with a technical and specialized approach using special agents and criteria.
The present study was conducted through a descriptive-analytical study in the form of a library and through taking notes.
Based on the security-oriented approach, it is the provision of public security and sovereign rights that takes precedence over individual rights and freedoms and legitimizes the non-observance of these rights and freedoms by governments. Therefore, deviating from the principle of innocence and changing the burden of proof, not paying attention to the principle of individuality of the sentence and the case of the person, deviating from the principle of materiality of the crime, spreading the accuracy of evidence, deviating from the principles of jurisdiction, expediting criminal proceedings, ignoring The balance between the rights of the accused and the victim and the centrality of the proceedings are among the most important components of the differentiation of proceedings in the realm of crimes against security.
