Difficulty and embarrassment of wife in Iranian and British law
One of these important and fundamental rules that is widely used in family law is the rule of difficulty and hardship, which, in addition to its flow in many chapters of jurisprudence, has also been manifested in relevant laws and is the key to unlocking many issues, including divorce. Therefore, due to the importance of the topic, it is necessary and inevitable to carefully examine the elements and conditions of causing hardship and embarrassment, as well as its application in divorce at the request of the wife. Since issues related to the family have always been viewed with special sensitivity and there have been many supporters and opponents for the smallest of these issues, this research, using the library method and authentic documents as a tool, seeks a comparative analysis of Asr. And the harm of the wife is in Iranian law and English law. The results showed that the request for divorce due to hardship in Iranian law is only possible by the woman by proving certain cases; While the divorce laws in England allow both men and women to file for divorce if one of the hardships is proved.
