سیستم ثبت اختراع از مدتها پیش به دلیل محدود کردن دسترسی به داروها مورد انتقاد قرار گرفته است. پیشرفت های چشمگیر در فناوری هوش مصنوعی و یادگیری ماشینی فرصتی متحول کننده در کشف دارو، فرمول بندی و آزمایش اشکال دارویی است. صنعت داروسازی مدعی است که ثبت اختراع برای تشویق نوآوری در فرآیندهای تحقیق و توسعه ی (R&D) پرخطر، طولانی و پرهزینه، ضروری است. شواهد منطقی در مورد آثار واقعی پاتنت ها بر نوآوری وجود ندارد. افزایش استفاده از هوش مصنوعی در تحقیقات، بحث های موجود در مورد پاتنت های دارویی را تشدید می کند. ابداعات دارویی به کمک هوش مصنوعی سوالاتی را در مورد قابلیت ثبت اختراع و سیاست ثبت اختراع مطرح می کند و این جریان را با چالشهایی مواجه میکند. از جمله میتوان به این مسئله اشاره کرد که در صورت تحقیق و توسعه سریعتر و کارآمدتر به کمک هوش مصنوعی چگونه میتوان برای این ابداعات حق پاتنت قائل شد. در این مقاله این سوال مطرح می شود که آیا در موراد کاربرد هوش مصنوعی در تحقیق و توسعه دارو آیا می توان نسبت به آن حق اختراع قائل شد و مشمول داروهای اصیل قرار داد. یافتهای تحقیق حاکی از آن است که به رغم ضرورت تداوم انگیزه برای تحقیق و توسعه دارو ، قانونگذاران باید سیستم های جایگزینی را در نظر بگیرند که دسترسی را در کنار انگیزه سازی در اولویت قرار دهد تا مراقبت های بهداشتی را به عنوان یک حق بشری پیش ببرند.

Dramatic advances in artificial intelligence and machine learning technology present a revolutionary opportunity in drug discovery, formulation and testing of dosage forms. The pharmaceutical industry claims that patenting is necessary to encourage innovation in the risky, lengthy, and costly research and development (R&D) process. But it still does not provide logical evidence about the actual effects of patents on innovation. The increasing use of artificial intelligence in research is intensifying the debate about pharmaceutical patents. Inventions created or enabled by artificial intelligence raise questions about patentability and patent policy in general. Faster and more efficient research and development weakens the justification for pharmaceutical patents. Research findings suggest that despite the necessity of continuing incentives for drug research and development, lawmakers should consider alternative systems that prioritize access alongside incentives to advance healthcare as a human right.

Safranal (a monoterpene aldehyde) is the major volatile component of saffron which is responsible for the saffron unique odor. Several studies have shown the pharmacological activities of safranal including anti-oxidant, anti-inflammatory, cardioprotective, neuroprotective, nephroprotective, gastrointestinal protective, etc. This study was designed to review the pharmacological and medical effects of safranal and up-to-date previous knowledge. Moreover, some patents related to the pharmacological effects of safranal were gathered. Therefore, electronic databases including Web of Sciences, Scopus, and Pubmed for pharmacological effects and US patent, Patentscope, and Google Patent for patents were comprehensively searched by related English keywords from 2010 to June 2022. According to our review, most of the studies are related to the safranal effects on CNS such as antianxiety, analgesic, anticonvulsant, antiischemic, anti-tremor, memory enhancement and its protective effects on neurodegenerative disorders such as Alzheimer’s, Parkinson and Huntington diseases. Other effects of safranal are antiasthmatic, antihypertensive, antiaging, anticataract, etc. Moreover, the protective effects of this agent on metabolic syndrome and diabetic nephropathy have been shown. Different mechanisms including anti-oxidant, anti-inflammatory, muscle relaxation, antiapoptotic, and regulatory effects on the genes and proteins expression related to signaling pathways of oxidative stress, inflammation, apoptosis, proliferation, etc. are involved in safranal pharmacological effects. Some patents for the prevention and/or treatment of different diseases such as liver cancer, sleep disorder, depression, cognitive disorder, obesity and PMS were also included. Based on the documents, safranal is considered a promising therapeutic agent although more clinical studies are needed to verify the beneficial effects of safranal in humans.

BACKGROUND
Intellectual property rights (IPRs) are increasingly becoming significant for sustainable growth of today’s knowledge‑based society. An inappropriate knowledge regarding IPR can fail to reserve rights for one’s intellectual creation. Hence this study was planned with an aim to assess knowledge, awareness, and practices regarding intellectual property rights in India amongst the health-care professionals in Belagavi city.
MATERIALS AND METHODSA descriptive cross‑sectional study was conducted among the postgraduate students and faculty of six health‑care professional institutions in Belagavi, Karnataka. A total of 724 responses were recorded using convenient sampling. Data was collected using self‑administered validated questionnaire which included demographic details and total 20 questions pertaining to knowledge, awareness, and practices regarding IPR. Two‑point Likert scale was used. Descriptive statistics, Mann–Whitney U‑test, and Chi‑square test were applied.
RESULTSA total of 724 responses were recorded, 411 from postgraduate students and 313 from faculty of 6 health‑care professional institutions. It was observed that 24.3% and 39.3% of postgraduate students and faculty participants, respectively, had maximum knowledge while 35.5% of faculty and 27.5% of postgraduate students had maximum awareness regarding IPR in India. Only 17.6% and 10.2% of faculty and postgraduate students had previously attended workshops on IPR.
CONCLUSIONThe present study identified that both faculty and postgraduate students of health‑care profession have less knowledge and awareness regarding IPR. However, both knowledge and awareness regarding IPR were better among faculty when compared to postgraduate students. Thus, the academic community requires a higher level of sensitization and exposure to IPR in India.

Myxomas are rare cardiac neoplasms and may present as single or multiple tumors. Only a few cases of single biatrial myxomas have been reported. We report a very rare case of this condition in a middle-aged woman, presenting with exertional dyspnea and cough. The patient had a resting tachycardia of 105 beats per minute, and cardiac auscultation discovered a mid-diastolic murmur across the mitral valve, followed by a tumor plop focused on the apex and elevated levels of C-reactive protein (1+) and creatine phosphokinase in lab data. The diagnosis was made via transesophageal and transthoracic echocardiographic examinations, showing the tumor extension through a patent foramen ovale (PFO). The operation was undertaken, the myxoma was excised, and the PFO was repaired. She was discharged with no further complications. Although myxomas are rare, considering this condition before surgery is significant. The involvement of both atria via a PFO is possible.

Background
Patent ductus arteriosus (PDA) is one of the more common congenital heart defects in preterm neonates. The closure of PDA can be done with ibuprofen; however, this drug is associated with many contraindications and potential side‑effects. In the past years, paracetamol has been proposed for the treatment of PDA. This study was designed to evaluate the efficacy and gastrointestinal complications of paracetamol and ibuprofen for the pharmacological closure of PDA in preterm infants.
MethodsIn a clinical trial study, 40 preterm infants with echocardiographically confirmed PDA were randomly assigned to receive either paracetamol (n = 23; 15 mg/kg every 6 h for 2 days) or ibuprofen (n = 17; initial dose of 10 mg/kg, followed by 5 mg/kg every 12 h for 2 days). The neonates matched for gestational age and weight. We used t‑test for parametric, Chi‑square for categorial, and Wilcoxson for nonparametric variables. Significant level was considered less than 0.05.
ResultsPlatelet count, BUN and creatinine levels, and closure of PDA had not significant difference between two groups (P > 0.05). Incidence and severity of GI bleeding, feeding intolerance, and NEC were significantly more in infants who received paracetamol than ibuprofen (P < 0.05).
ConclusionsThere were no differences in the rate of PDA closure between the two drugs, but with respect to complications, rate and severity of GI bleeding, feeding intolerance, and NEC were significantly more in infants who received paracetamol than ibuprofen. Therefore, paracetamol could not be used as a proper alternative agent for ibuprofen in the treatment of PDA in preterm infants.

بررسی قابلیت ثبت اختراعات مربوط به سلولهای بنیادی انسانی مستلزم این است که در مرحله اول نوآوری های این حوزه از موضوعات قابل ثبت تلقی شوند و سپس تطبیق شرایط سه گانه ثبت اختراع بر نوآوری های این حوزه ممکن باشد. توجه به بیان عام قوانین ثبت اختراع در هر سه نظام حقوقی اختراعات این حوزه از موضوعات قابل ثبت تلقی می شوند. تطبیق شرایط سه گانه ثبت اختراع بر اختراعات این حوزه نیز با چالش هایی مواجه است که در دو نظام حقوقی آمریکا و اروپا تلاش شده است از طریق ارایه شاخص های احراز هر یک از شرایط سه گانه ثبت اختراع به این چالش ها پاسخ داده شود.
مواد و روشهااین مقاله توصیفی تطبیقی، و با بهره گیری از روش اسنادی و استفاده از ابزار فیش برداری تهیه و تدوین گردیده است.
یافتههانظام ثبت اختراع ایران فاقد دستورالعمل های ارزیابی کافی برای ارزیابی اختراعات این حوزه بوده و ارزیابان دارای مهارت کافی نیز در این حوزه ندارد. از سوی دیگر نظام های ثبت اختراع آمریکا و اروپا در دو دهه گذشته با چالش تطبیق شرایط ثبت اختراع بر نوآوریهای این حوزه مواجه بوده و برای حل معضلات این امر به راهحلهای مناسبی دست یافتهاند. ملاحظات اخلاقی: در تمام مراحل نگارش پژوهش حاضر، ضمن رعایت اصالت متون، صداقت و امانتداری رعایت شده است.
نتیجهگیریبا توجه به کاستی های نظام ثبت اختراع ایران به ویژه عدم وجود دستورالعمل های ارزیابی و نبود ارزیابان تخصصی اختراع در ایران انتخاب معیارهای سخت گیرانه تر برای ارزیابی اختراع نظام ثبت اختراع را با چالش جدی مواجه می کند. به طور کلی مناسب است معیارهای مورد توجه در دو نظام حقوقی مذکور در احراز شرایط ثبت اختراع برای جلوگیری از ابهامات و دعاوی مشابه که در این دو نظام حقوقی مطرح شده است در قانون ثبت اختراعات یا آیین نامه مربوطه مورد تصریح قرار گیرد. رویکرد نظام حقوقی آمریکا در اعمال این شاخصها سختگیرانه تر است. با توجه به ویژگیهای نظام ثبت اختراع ایران انتخاب رویکرد سهلگیرانه میتواند کار ارزیابی را کم هزینه تر و ساده تر سازد. برای نمونه مناسب است تصریح شود که سلولهای بنیادی انسانی با توجه به اینکه از عناصر طبیعی هستند باید از محیط طبیعی آن جدا شده و با حداقلی از مداخله فنی همراه باشند تا جدید تلقی شوند. همچنین مناسب است برای احراز گام ابتکاری به ضرورت توجه به «اثر غیرمنتظره فنی» و «احساس نیاز» در زمان تقاضای ثبت اختراع توجه شود. برای اعمال شرط کاربرد صنعتی بر نوآوریهای این حوزه نیز سه شاخص معین، ملموس و قابل توجه بودن پیشنهاد میشود.

Paying attention to the general expression of patent laws in all legal systems, patents in this field are considered as registrable issues. Applying the three patent requirements to patents in this field also faces challenges that in both US and European legal systems have tried to address these challenges by providing indicators of each of the three patent requirements useful to realize existence of each requirements in a given case.
Materials and MethodsThis research is of theoretical type and the research method is comparative and descriptive-analytical and the method of data collection is library and has been done by referring to documents, books and articles.
ResultsIran's patent system does not have sufficient examination guidelines to examine inventions in this field and examiners do not have sufficient skills. On the other hand, US and European patent systems in the last two decades have faced the challenge of applying patent requirements to innovations in this field and have found appropriate solutions to solve their problems which could be a shortcut for Iran patent system. Ethical considerations: All ethical considerations including the authenticity of the texts, honesty and fidelity have been observed in order to organize this research.
ConclusionDue to the shortcomings of the Iranian patent system, especially the lack of examination guidelines and the lack of specialized patent examiners in Iran, the selection of more stringent criteria for patent examination of the patent system faces serious challenges. In general, it is appropriate that the criteria considered in some other legal systems mentioned in the patent requirements to avoid ambiguities and similar lawsuits raised in these legal systems be specified in the patent law or relevant regulations. The US legal system is more rigorous in applying these requirements. Due to the characteristics of the Iranian patent system, choosing the easier approach can make the examination work less expensive and more commensurate. For example, it is appropriate to specify that human stem cells, given that they are natural elements, must be isolated from their natural environment and accompanied by a minimum of technical intervention to be considered new. It is also appropriate to consider the need for "unexpected technical effect" and "sense of continuous demand" in order to finding innovative step. To apply the requirements of industrial application three indicators of being specific, tangible and significant are suggested.

Background
The superior type of sinus venosus atrial septal defect (SVASD) is a rare form of the atrial septal defect (ASD) in which the upper part of the atrial septum does not exist. The presence of other cardiac anomalies such as anomalous pulmonary venous connections has been reported in this type of congenital heart disease. This study aimed to assess the presence of the patent foramen ovale (PFO) in patients with the superior type of SVASD.
MethodsThis retrospective case-control study on 387 patients, consisting of 187 patients with a definite SVASD and 200 patients with problems other than the ASD, was conducted in Rajaie Cardiovascular Medical and Research Center between February 2005 and July 2014. Seven patients with inadequate data were excluded from the analysis. The presence/absence of the PFO was also evaluated in the case and control groups.
ResultsThe analyses were performed on 182 male and 198 female patients at a mean age of 39.07±14.41 and 51.01±15.80 years in the case and control groups, respectively. The PFO was significantly more frequent in the patients with the superior type of SVASD than in those without the condition (P<0.001). The persistence of the left superior vena cava was seen in 34 out of 180 patients with SVASD and in 1 out of 200 patients without the condition (18.9% vs 0.5%; P<0.001).
ConclusionThis study was the first to highlight the coexistence of the PFO and the superior type of SVASD. Physiological, genetic, or fetal factors may play an important role in the association between the PFO and the SVASD.

سلول های بنیادی انسانی یکی از منابع مهم پزشکی جهت درمان بیماری های مختلف و از حوزه های پرچالش حقوق ثبت اختراعات محسوب می شوند. دامنه این چالش متناسب با رویکردهای حقوقی کشورها معطوف به نحوه احراز شرایط ماهوی از یکسو و ملاحظات اخلاقی به خصوص در زمینه سلول های بنیادی جنینی، از سوی دیگر می باشد. بر این اساس، اگرچه این سلول ها به شرط احراز معیارهای ماهوی می توانند موضوعات قابل ثبتی محسوب شوند، لیکن به استناد برخی ملاحظات نظم عمومی و اخلاق حسنه ممکن است به عنوان اختراع، قابل بهره برداری نباشند. بررسی پرونده های ذی ربط در اتحادیه اروپا و ایالات متحده نشان از تفاوت رویکرد این کشورها دارد. تاکید بیشتر آمریکا بر روی مطابقت اختراعات این حوزه با شرایط ماهوی و حساسیت اتحادیه اروپا بیشتر بر روی مطابقت آن ها با نظم عمومی و اخلاق حسنه می باشد. با پیشرفت تکنولوژی و دستیابی به انواع مختلف سلول های بنیادی از راه هایی به جز تخریب جنین نظیر تکنولوژی انتقال هسته سلول سوماتیک، سلول های بنیادی القا شده و... مباحث حقوقی ثبت این سلول ها متحول شده است. درحقیقت، به واسطه دستیابی به این سلول ها بدون تخریب جنین و فرآیندهای صورت گرفته بر روی آن ها مانند آنچه در سلول های بنیادی القایی صورت می گیرد، دیگر نمی توان اختراعات این حوزه را به دلیل مشابهت با حالت طبیعی موجود در بدن انسان و یا تضاد با حفظ کرامت انسانی کاملا نادیده گرفت. در این مقاله رهیافت های حقوقی ثبت اختراع سلول های بنیادی انسانی بر مبنای رویه های قضایی اخیر اروپا و ایالات متحده مورد بررسی قرار گرفته و روش تحقیق حاضر تحلیلی تطبیقی مبتنی بر مطالعات کتابخانه ای است. در خاتمه نتیجه گیری شده علی رغم تفاوت دیدگاه ها، روند ثبت این اختراعات به ویژه به لحاظ کاربردهای درمانی مهم و متعدد آن ها رو به افزایش بوده و چالش های ذی ربط نیز به نحو مقتضی از طریق رویه های قضایی مدیریت شده است.

The scope of this challenge relying on the legal approaches of countries depends on how to satisfy substantive requirments and moral considerations, especially in the field of embryonic stem cells. Accordingly, although such cells could be considered patentable subject matter on the basis of substantive requirements, they may not be commercially exploited as an invention on the basis of some considerations of public order and morals. An examination of the relevant case law in the European Union and the United States shows the differences in their approach. The greater emphasis of United States is on the compatibility of such inventions with the patentability requirements and the EU's tendency is more on their compliance with moral considerartions. With the advancement of technology and the achievement of different types of stem cells in ways other than embryo destruction such as somatic cell nuclear transfer technology, induced pluripotent stem cells and so on the legal issues surrounding the patentability of these cells have changed. In fact, because of accessibility to these cells without the destruction of the embryo and the processes that take place on them, like what happens in induce pluripotent stem cells, such inventions can no longer completely ignore because of its similarity to the natural state in human body or conflict with protecting human dignity. In this paper, the legal approaches to patenting human stem cells based on recent European and US jurisprudence have been reviewed and the present research method is analytical-comparative based on library studies. Finally concludes that despite the differing approaches, patenting these cells has been increasing, especially because of their important and numerous therapeutic applications and the related challenges have been adequately managed through judicial procedures.

مقدمه
تجزیه و تحلیل استناد در پروانه های ثبت اختراع به پژوهشهای علمی و مجلات، یکی از روش های موجود برای اندازهگیری رابطه بین علم و فنآوری محسوب میشود. از اینرو، پژوهش حاضر با هدف تعیین میزان استناد به مجلات انگلیسی زبان ایرانی زیر نظر وزارت بهداشت، درمان و آموزش پزشکی در پروانه های ثبت اختراع موجود در پایگاه ثبت اختراع و علایم تجاری آمریکا USPTO (United States Patent and Trademark Office (صورت گرفت.
روش بررسیاین مطالعه به روش توصیفی و با رویکرد علمسنجی انجام شد. جامعه تحقیق متشکل از 268 مجله انگلیسی زبان زیر نظر وزارت بهداشت، درمان و آموزش پزشکی ایران بود که عناوین آنها در USPTO مورد جستجو قرار گرفت.
یافته هادر مجموع، فقط به 49 مورد از مجلات وزارت بهداشت استناد شده بود که تعداد پروانه های ثبت اختراع استنادکننده، 207 مورد بود. مجله Advanced Pharmaceutical Bulletin بیشترین استناد را از سوی پروانه های ثبت اختراع دریافت کرده بود. 65 درصد از پروانه های ثبت اختراع استنادکننده به مجلات وزارت بهداشت، در رده اصلی A نیازهای « یعنی قرار گرفتند. بیشتر پروانه های ثبت اختراع استنادکننده به مجلات وزارت بهداشت متعلق به آمریکا و مالک بیشتر آنها دانشگاه استنفورد میباشد. » انسانی
نتیجه گیریمجلات انگلیسی زبان ایرانی با بهرهگیری از فرایند و راهبردهای لازم طبق سیاستها و نظارت بر آنها، میتوانند در سطح بین المللی جایگاه بهتری از لحاظ وضعیت مقالات و فنآورمحور بودن داشته باشند. بنابراین، با توجه به انتشار روزافزون مقالات در کشور، باید به کیفیت آنها بیشتر از کمیت توجه شود.

The purpose of this research was to investigate citations to English-language journals approved by Iranian Ministry of Health and Medical Education in patents registered in the United States Patent and Trademark Office (USPTO) database.
MethodsThis descriptive survey was conducted based on citation analysis and scientometrics techniques. The study population included 268 English-language journals approved by the Iranian Ministry of Health and Medical Education. The title of each journal was used to search at the USPTO database.
Results207 patents cited to 49 English-language journals approved by Iranian Ministry of Health and Medical. Note that 65% of patents in this group were in the class A (i.e., human necessities). Most patents citing Iranian medical journals belonged to the United States, and were assigned by Stanford University.
ConclusionIranian journals, using the necessary processes and strategies according to their policies, can have a better internationally position in terms of article status and being technology-centered. Therefore, due to the increasing publication rate of articles in the country, their quality should be considered (focused on) more than quantity.

زمینه و هدفپژوهش حاضر با هدف تحلیل هم رخدادی واژگان پروانه های ثبت اختراع حوزه تجهیزات پزشکی و آزمایشگاهی طی سال های 1984 تا 2014 میلادی در پایگاه اداره ثبت اختراع و علایم تجاری آمریکا انجام شد.روش بررسیاین پژوهش از نوع مطالعات کاربردی و با تکنیک علم سنجی و تحلیل هم واژگانی انجام شده است. جامعه آماری پژوهش حاضر، کلیه پروانه های ثبت اختراع حوزه تجهیزات پزشکی و آزمایشگاهی است که در پایگاه اداره ثبت اختراع و علایم تجاری آمریکا در بازه زمانی 1984 تا 2014 میلادی ثبت شده بود. در نتیجه ی این جستجو، 13424 پروانه ثبت اختراع بازیابی شد.یافته هایافته های پژوهش نشان داد که از نظر فراوانی، کلیدواژه ی"مایع قاعدگی" و از نظر هم رخدادی دو کلیدواژه ی"مایع قاعدگی- تجهیزات تصویر رزونانس مغناطیسی" بیشترین فراوانی را در پژوهش های حوزه تجهیزات پزشکی و آزمایشگاهی داشته اند. یافته های مربوط به خوشه بندی سلسله مراتبی به روش"وارد" منجر به شکل گیری هشت خوشه در این حوزه شد که این خوشه ها بدین شرح بودند: تجهیزات عمومی، تجهیزات توانبخشی، تجهیزات دندانپزشکی، تجهیزات درمانی، تجهیزات اورژانس، تجهیزات آزمایشگاهی، تجهیزات تشخیصی، لوازم مصرفی پزشکی.نتیجه گیریتحلیل هم رخدادی واژگان به خوبی ساختار علمی حوزه تجهیزات پزشکی و آزمایشگاهی را نشان داده است و بر این اساس موضوعات علمی استخراج و ارتباط میان آن ها کشف شد. نقشه های هم واژگانی، تغییرات و پایداری ها در مفاهیم و واژه های مرتبط با این حوزه ی علمی را نشان داده است.کلید واژگان: هم رخدادی واژگان, ترسیم ساختار علمی, پروانه ثبت اختراع, اداره ثبت اختراع و علایم تجاری آمریکا, تجهیزات پزشکی و آزمایشگاهی}Background and AimThe purpose of this study was to analyze the co-occurrence of the terms of medical and laboratory equipment patents in the United States Patent and Trademark Office between 1984 and 2014.Materials and MethodsThis research was an applied study using scientometrics and co-word analyses. The statistical population of the present study included all patents of medical and laboratory equipment registered in the United States Patent and Trademark Office database between 1984 and 2014. As a result, a total of 13424 patents were retrieved.ResultsThe results revealed that in terms of frequency, the keyword "Menstrual Fluid" and in terms of co-occurrence, two keywords (Menstrual Fluid and Magnetic Resonance Image Apparatus) were the most frequent ones in medical and laboratory equipment studies. The results of hierarchical clustering with "Ward's method" led to the formation of eight clusters in this area including the following: General Equipment, Rehabilitation Equipment, Dental Equipment, Therapeutic Equipment, Emergency Equipment, Laboratory Equipment, Diagnostic Equipment, and Medical Consumables.ConclusionThe analysis of the co-occurrence of words revealed the scientific structure of medical and laboratory equipment well. Accordingly, the scientific issues were extracted and the relationship between them was discovered. زمینه و هدفبا توجه به رشد تولیدات علمی در سال های اخیر، این سوال همیشه در محافل علمی و جامعه مطرح است که چقدر تولیدات علمی منجر به رفع مشکلات جامعه شده است و چند درصد آنها منجر به تولید کالا، خدمات و کار در کشور شده است. در این راستا پژوهش حاضر ثبت اختراعات حوزه جراحی را در سطح جهانی و جایگاه ایران در این زمینه را مورد بررسی قرار داده است تا مشخص شود چه میزان اختراع از دل تولیدات علمی که بیشتر هم مقاله هستند، استخراج می شود.مواد و روش هاروش این پژوهش علم سنجی می باشد که با استفاده از داده های پایگاه استنادی اسکوپوس و موتور تعبیه شده بر روی آن انجام شد. همچنین از نرم افزار اکسل جهت ترسیم جداول و نمودارها استفاده شد.یافته هایافته های این پژوهش نشان داد که کشورهای آمریکا، ژاپن، انگلستان، آلمان، ایتالیا، چین، فرانسه، کانادا، هند و ترکیه به ترتیب در رتبه های اول تا دهم از حیث ثبت اختراع در زمینه جراحی را به خود اختصاص داده اند. کشور ایران نیز در رتبه بیست و سوم قرار دارد. سایر یافته ها از این حیثت طبق داده های این پایگاه نشان می دهد که روند ثبت اختراع در جراحی در سالهای اخیر با اندکی کاهش روبرو بوده است. به طوری که در سال 2014 با 757 مورد، سال 2015 با 729 مورد، سال 2016 با 716 مورد ، 2017 با 692 مورد و 2018 با 660 مورد روند کاهشی داشته است.نتیجه گیریسیر رشد تولیدات علمی در حوزه جراحی در دنیا و کشورمان رشد نسبتا خوبی داشته است ولی از حیث ثبت اختراع در این حوزه چشمگیر نیست. شاید یکی از دلایل آن را محدود کردن ثبت اختراعات به جراحان دانست چرا که ممکن است جراحی در یک اختراع، همکاری و نقش داشته باشد ولی به دلایلی نام و مشخصات سازمانی وی ثبت نشده است یا بسیاری از این اختراعات در حوزه پزشکی به صورت عام ثبت شده و از این حیث جایگاه جراحان در ثبت اختراع با کاهش مواجه شده است. عدم آشنایی جامعه جراحی با شیوه های ثبت اختراع می تواند یکی دیگر از علل باشد. چرا که روش های جراحی در قوانین اکثر کشورها از جمله موارد استثناء شده از اختراعات قابل ثبت هستند. ولی بسیاری از جراحان اهمیت نداده و آن را ثبت نمی کنند به همین دلیل شاید یکی از دلایلی است که باعث عدم رشد ثبت اختراع در این حوزه را شاهد هستیم.کلید واژگان: ثبت اختراع, پایگاه استنادی اسکوپوس, جراحی, نوآوری}Introduction & ObjectiveDue to the growth of scientific production in recent years, this question has always been raised in scientific circles and society, how much scientific production has led to the elimination of the problems of society and how many of them led to the production of goods and services and jobs in a country. In this regard, the present study has investigated the scope of surgical field patents at the global level and Iran's position in this field in order to determine the extent of the invention from the point of view of scientific production.Materials & MethodsThe method of this study is scientometric, using Scopus citation database and embedded engine on it. Also, Excel software was used to draw tables and charts.ResultsThe results of this study showed that the United States, Japan, the United Kingdom, Germany, Italy, China, France, Canada, India and Turkey ranked first to tenth in terms of patents for surgery, respectively. Iran is ranked 23rd. Other findings, according to data from this site, indicate that the patent process has been slightly decreased in recent years. With 757 in 2014, 729 in 2015, 2016 in 716, 2017 in 692 cases, and 2018 in 660 cases.ConclusionsThe growth of scientific production in the field of surgery in the world and Iran has grown relatively well. Perhaps one of the reasons for this is limiting patents to surgeons, since surgery may has an inventive, cooperative, and involved role, but for some reasons its name has not been documented or many of these inventions have been documented in general. In this regard, the status of surgeons in the patent has declined. Understanding the surgical community with patent practices can be another cause. Because surgical procedures are subject to the laws of most countries, including exceptions from patents. امروزه با افزایش بیماریهای گوناگون، زندگی جوامع بشری بیش از پیش با خطر مواجه است. از این رو صنعت داروسازی یکی از مهمترین صنایعی است که باید مورد حمایت قرار بگیرد تا انگیزه برای ابداع داروهای جدید برای بیماریهای خطرناک و نوظهور و همینطور انگیزه برای تولید وسیع این داروها برای مخترعین و شرکتهای سرمایهگذار در این صنعت حفظ شود. در مقابل مزیتهای انکارناپذیر حمایت از مخترعین و تولیدکنندگان دارو، این حمایت میتواند موجب گردد برخی کشورها بالاخص کشورهای در حال توسعه و کمتر توسعهیافته، با تهدیدات جدی نسبت به بهداشت عمومی و عدم امکان دسترسی به داروهای تحت حمایت حقوق مالکیت فکری، رو به رو شوند. در این مواقع کدام یک از این دو مصلحت بر دیگری ارجحیت دارد؟ حمایت از صنایع دارویی و یا حفاظت از بهداشت عمومی جوامع در مقابل تهدیدات؟ بر همین اساس این مقاله، تسهیل دسترسی به دارو برای کشورهای در حال توسعه و کمتر توسعهیافته را توسط سازمان تجارت جهانی، با تاکید بر تحولات معاهده تریپس بررسی کرده است. اجمالا باید گفت در کنار سازمان بهداشت جهانی که وظیفهاش کمک به حفظ سلامت است، سازمان تجارت جهانی تلاش کرده است از طریق درج برخی مواد در موافقتنامه تریپس و همچنین «اصلاح» آن، ضمن حفظ اصول بنیادین خود نظیر آزادی تجارت و اصل عدم تبعیض، از بهداشت عمومی جوامع در مقابل تهدیدات حمایت کند تا از این طریق از تعارض بین این دو امر حیاتی جلوگیری کند.

Therefore, the pharmaceutical industry is one of the most important industries to be supported in order to maintain the incentive to invent new drugs for dangerous and emerging diseases, as well as the incentive to produce widespread pharmaceuticals for inventors and investment companies in the industry. Against the undeniable advantages of protecting inventors and drug manufacturers, this support can lead to the emergence of some countries, especially developing and least developed countries, with serious threats to public health and the inability to access proprietary drugs, they face. Which of these two options is preferred over the other? Protecting the pharmaceutical industry or protecting public health against threats? Accordingly, the paper examines the World Trade Organization's Facilitation of Drug Access for Developing Countries and least developed countries with emphasis on developments in the Trips Treaty. In short, along with the World Health Organization, whose role is to help maintain health, the World Trade Organization has tried to incorporate some of the acts in the trips agreement as well as its "reform", while maintaining its fundamental principles, such as freedom of trade and the principle of non-discrimination, to protect public health from threats, in order to prevent the conflict between the two.

مقدمهرعایت الزامات حقوق بشری به عنوان قواعد عام الشمول در انعقاد موافقت نامه های بین المللی از جمله موافقت نامه های سازمان تجارت جهانی امری لازم و ضروری است و بر این اساس، تعهد تضمین حق دسترسی به داروهای اساسی به عنوان یکی از استحقاقات و مصادیق حق بر سلامتی که ارتباط معناداری نیز با حق حیات دارد، برای دولت ها امری اجتناب ناپذیر است.مواد و روش هاتحقیق حاضر با استفاده از روشی توصیفی – تحلیلی مقررات میثاق بین المللی حقوق اجتماعی، اقتصادی و فرهنگی را در خصوص حق دسترسی به داروهای اساسی به عنوان حقی حقوق بشری که می تواند با بحث حمایت از ابداعات دارویی به عنوان یکی از مصادیق حق ثبت اختراع که در موافقت نامه تریپس سازمان تجارت جهانی به عنوان جنبه ای تجاری از حقوق مالکیت فکری با وصف حقوق خصوصی مورد حمایت قرار گرفته، را بررسی می کند.
یافته های پژوهش: براساس مقررات موافقت نامه تریپس در خصوص حق ثبت اختراع، از جمله مواد 27 و 28، دارنده حق مالکیت فکری حقوقی انحصاری در خصوص ساخت، استفاده، عرضه برای فروش، فروش یا واردات ، پیدا می کند که می تواند چالش دسترسی به داروهای اساسی و افزایش قیمت چنین داروهایی را به دنبال داشته باشد و این موضوع به طور خاصی کشورهای در حال توسعه و کمتر توسعه یافته را در خصوص تعهد احترام، حمایت و اجرای حق دسترسی به داروهای اساسی را با مشکل مواجه می سازد.بحث و نتیجه گیریعلاوه بر تمهیدات مندرج در متن موافقت نامه تریپس درباره استثناهای محدود و مجوزهای اجباری، تصویب اعلامیه اجلاس دوحه در خصوص موافقت نامه تریپس و سلامت عمومی و همچنین صدور تصمیم شورای تریپس در خصوص اجرای مفاد بند 6 این اعلامیه، به عنوان راهکارهای در نظر گرفته شده که عملا تعارض بین مقررات این موافقت نامه و الزامات حقوق بشری را حل و فصل کرده است.کلید واژگان: الزامات حقوق بشری, موافقت نامه تریپس, دسترسی به داروهای اساسی, حق ثبت اختراع, مجوزهای اجباری}IntroductionThe observance of human rights requirements as a general rule in concluding international agreements, such as the WTO agreements, is necessary and, accordingly, a commitment to guarantee the right to access basic medicines as one of the titles and examples of the right to health, which has a meaningful relationship. It also has the right to live which is inevitable for governments.Materials and MethodsThe present study uses a descriptive-analytical method to determine the provisions of the International Covenant on Economic, Social, and Cultural Rights on the Right to Access to Essential Medicines as Human Rights, which can be considered as one of the examples of support for pharmaceutical innovations. The patent that is protected by the World Trade Organization's Trips agreement as a trade-mark of intellectual property rights is protected by the definition of private law.
Findings: Based on the provisions of the Trips Agreement on Patents, including Articles 27 and 28, the holder holds the exclusive intellectual property right to manufacture, use, supply for sale, and sale or import, which can challenge the access to medicines. The underlying cause and the increase in the cost of such drugs, and this in particular, makes it difficult for developed and less developed countries to respect the commitment to support and enforce access to essential medicines.
Discussion &ConclusionsIn addition to the provisions of the Trips Agreement on limited exceptions and compulsory licenses, the approval of the Doha Summit Declaration on the Trips and Public Health Agreements, as well as the issuance of the Trips Council Decision on the implementation of the provisions of paragraph 6 of this Declaration, are considered as solutions. مقدمهپزشکی و فن آوری های مربوط به آن، یکی از مسایل قابل توجه در تاریخ کشورهای اسلامی محسوب می شود، اما به نظر می رسد که وضعیت کنونی این حوزه چندان مطلوب نیست. پژوهش حاضر با هدف بررسی وضعیت توسعه فن آوری پزشکی با استفاده از تحلیل پروانه های ثبت اختراع حوزه پزشکی کشورهای اسلامی در پایگاه بین المللی ثبت اختراع آمریکا انجام شد.روش بررسیاین پژوهش، توصیفی و از نوع کاربردی بود و جامعه آن را کل پروانه های ثبت اختراع حوزه پزشکی کشورهای اسلامی ثبت شده در پایگاه ثبت اختراع و علایم تجاری آمریکا از ابتدا تا سال 2014 تشکیل داد. داده ها با استفاده از ترکیب فیلدهای نام کشورها و رده جستجو و با استفاده از نرم افزار USPTO استخراج گردید. از نرم افزار USPTO 2 برای به دست آوردن اطلاعات مورد نیاز از هر پروانه ثبت اختراع، از نرم افزار PATREF 5 جهت استنادهای پروانه های ثبت اختراع و از نرم افزار GPS Visualizer جهت ترسیم نقشه پراکندگی جغرافیایی پروانه های ثبت اختراع استفاده شد.یافته هایافته ها نشان داد که از بین 57 کشور اسلامی، تنها 26 کشور از جمله مالزی، ترکیه، عربستان، ایران، امارات و کویت در زمینه اختراعات حوزه پزشکی فعال بودند. از میان موضوعات دارای پروانه ثبت اختراع نیز موضوعاتی همچون داروسازی، ترکیبات ارگانیک، شیمی زیست مولکولی و میکروب شناسی، تجهیزات پزشکی و آزمایشگاهی، دندان پزشکی و جراحی های نوری، حرارتی و الکتریکی، بالاترین رتبه فعالیت را به خود اختصاص دادند. بیشترین ارتباطات کشورهای اسلامی با سایر کشورها در زمینه پروانه های ثبت اختراع حوزه پزشکی نیز با کشورهایی مانند آمریکا، فرانسه، کانادا، آلمان، بریتانیا، ژاپن، مالزی، ترکیه، عربستان و ایران صورت گرفته بود.نتیجه گیرینتایج پژوهش حاضر ضمن ارایه آگاهی به مسوولان کشورهای اسلامی از وضعیت فن آوری پزشکی در مقایسه با کشورهای دیگر، در حوزه سیاست گذاری کلان و خرد کشورهای اسلامی در حوزه مذکور نیز می تواند مفید باشد.کلید واژگان: پروانه ثبت اختراع, پزشکی, کشورهای اسلامی}IntroductionMedicine and its technology are the most important issues in the history of Islamic countries. However, their present condition in Islamic countries is not favorable. The aim of the present research was to assess the development of medical technology in Islamic countries through studying their medical patents in United States Patent and Trademark Office (USPTO).MethodsThe current research was a descriptive and applied study. The study population included all medical patents of Islamic countries registered until 2014 in the USPTO. The data were collected through combining the fields of countries names and the search classification, and by using the USPTO software. The required information from each patent was extracted using the USPTO 2. PATREF 5 was used for citation information and GPS Visualizer software was applied for the visualization of the geographic information map.ResultsThe analysis of the data showed that among the 57 Islamic countries; only 26 countries, including Malaysia, Turkey, Saudi Arabia, Iran, UAE, and Kuwait, had been active in medical inventions. The findings showed that subjects such as pharmaceuticals, organic compounds, molecular biology and microbiology, and medical and laboratory, dental, and optical, thermal, and electrical surgery equipment had the highest rank. The results also revealed that regarding medical patents, Islamic countries had the most communications with countries such as America, France, Canada, Germany, Great Britain, Japan, Malaysia, Turkey, Saudi Arabia, and Iran.ConclusionThe results of this study, in addition to providing Islamic countries authorities with knowledge on medical technology, and can be useful in macro and micro policies of Islamic countries in this field.Keywords: Patent, Medical, Islamic Countries}

سابقه و هدفدر عصر حاضر ارتباط دانشگاه و صنعت یکی از شاخص ترین عوامل رسیدن به توسعه محسوب می شود. بنابراین با توجه به اهمیت این موضوع، هدف از این مطالعه تحلیل مقایسه ای رابطه دانشگاه- صنعت در ایران و ترکیه است.مواد و روش هاپژوهش حاضر از نوع پژوهش های علم سنجی است که با استفاده از روش تحلیل استنادی و استفاده از تکنیک ارزیابانه انجام شد. جامعه آماری این تحقیق کلیه اختراعات ثبت شده و مقالات علمی مربوط به کشورهای ایران و ترکیه بر اساس اطلاعات پایگاه ثبت اختراعات آمریکا و اسکوپوس است. داده های این پژوهش با استفاده از آمار توصیفی (فراوانی و درصد) و آزمون استنباطی (همبستگی پیرسون)، نرم افزار Excel و SPSS مورد تجزیه و تحلیل قرار گرفت.یافته هایافته های این تحقیق نشان داد که کشور ایران و ترکیه در پایگاه اسکوپوس و ثبت اختراعات آمریکا تا زمان انجام این پژوهش به ترتیب 151159 و 258719 مقاله، 143 و 584 ثبت اختراع منتشر کرده اند. همچنین کشور ایران بر اساس اولویت های الف تا ج، در فناوری بیشترین تولید علم را داشته است. کمترین تولید علم با تعداد 5717 مربوط به حوزه علوم انسانی و هنر است. در مورد ثبت اختراعات بیشترین تعداد ثبت اختراع مربوط به علوم پایه و کاربردی است. کشور ترکیه بر اساس اولویت ها، کمترین تولید علم را در حوزه موضوعی مربوط به جهانگردی و حمل و نقل و بیشترین تولید را در حوزه سلامت و داروسازی داشته است.نتیجه گیریبا توجه به گذشت بیش از دو دهه از تاسیس دفتر ارتباط صنعت با دانشگاه در کشور ایران، تعامل مناسب بین این دو سازمان در دستیابی به سطح مطلوب در علم و فناوری برقرار نشده است. بنابراین بررسی نیازهای هر یک از دو سازمان توسط دولت و تعیین مسیر منطقی برای بهبود کیفیت تولیدات آنها و برنامه ریزی در سطح کلان از موارد ضروری برای بهبود این ارتباط است.

Therefore, because of its importance, the aim of this study was to analyze the relation between university and industry comparatively in Iran and Turkey.Material And MethodsThis scientometric study was conducted using citation analysis method and assessment technique. Sample population of this study was all of patents and scientific articles related to Iran and Turkey based on Us-patent and Scopus database. Data were analyzed by using descriptive statics (frequency and percent) and Inferential Tests (Pearson correlation), excel software and SPSS.FindingsThe results of the present study showed that Iran and Turkey had 151159, 258719 scientific articles and 143, 584 patents in Scopus and US-patent database, respectively. In addition, Iran had the highest scientific productions were in technology based on the priorities of A to C and the lowest scientific productions with 5717 was related to the humanities and art field. In the case of patent, the most of it was associated with basic and applied science. Based on priorities, Turkey had the lowest production in the field of tourism and transport and the most production in the health and medicine field.ConclusionAfter more than two decades of the establishment of the Office of the relationship between industry and university in the country, the proper interaction between the two organizations in achieving the desired level in science and technology has not been established. Diabetes mellitus is a heterogeneous complex metabolic disorder with multiple etiology which characterized by chronic hyperglycemia resulting from defects in insulin secretion, insulin action or both. The widespread occurrence of diabetes throughout the world has increased dramatically over the past few years. For better understanding, appropriate animal models that closely mimic the changes in humans needed, as vital tool for understanding the etiology and pathogenesis of the disease at the cellular/molecular level and for preclinical testing of drugs. This review aims to describe the animal models of type-1 diabetes (T1Ds) and T2Ds to mimic the causes and progression of the disease in humans. And also we highlight patent applications published in the last few years related to animal models in diabetes as an important milestone for future therapies that are aim to treating diabetes with specific symptoms and complications.

The number of research publications, patents, and H-index values of each country in pharmacy related fields, could be used as scientometric indicators of pharmacy research and education.MethodsFor this purpose we studied above mentioned factors for 102 counties consisting of; twenty finance ministers and central bank governors, European Union member countries, first twenty countries of the world in Human Development indices, Middle East countries, and members of Organization of the Islamic Conference. Scopus® was used to extract the bibliometric data. The correlation of some factors such as economical, educational, and research and development (R&D) indicators of the countries on the studied parameters were investigated.ResultsThe results of analyses showed that studied indicators are correlated with the number of publications, H-indices, and patents. This might suggest the possibility of the further researches in the field of mathematical representation in scientometrics.ConclusionResearch and development in pharmacy areas are affected by expenditure and the more the expenditure, the more the outcome of research and development.Keywords: Scientometrics, Pharmacy, Publication, H, index, Patent}
