The necessity of passing the physician from individual performance to Participatory performance (Through Using Comparative Law)

Abstract:
Background and Aim

Some of the challenges of the individual institute of the physician are inseparable from the method of its implementation. Lack of legal personality has consequences for the institution; the probability of closing the institution increases. The liability of the institution for the harmful behavior of the physician is removed and with the death of the owner, the common ownership situation of is imposed on the institution and as a result it becomes difficult to organize. The single individual centrality makes the institution not have the necessary dynamics, and ability during the life of the Licensee and at the time of his death deprives him of meritocracy in the matter of conferring privileges on the new person. Some other challenges are related to the performance method and this is especially true about inefficiency of individual performance in the face of Scientific and economic changes.

Materials and Methods

This research has been done by using the findings of comparative law and organizing participatory performance using descriptive-analytical method.

Results

Participatory performance is suggested as a way out of individual medical performance problems. Physicians seeking participatory performance can establish a medical company. Such a company can be defined as: "a legal entity consisting of physicians who practice medicine. The subject of this company is the joint implementation of the medical profession.

Ethical Considerations: 

In the present study, adherence to the scientific method, ethical principles, fiduciary duty and intellectual and intellectual property have been respected.

Conclusion

Participatory performance, with partner organization, brings physicians together to make specialization, substitution, relocation and meritocracy possible. By organizing activities, gives the institution a legal personality to divide the whole collection into partnerchr('39')s share and be guaranteed the continuity of physician services. Also, it is possible to concentrate capital and make optimal use of it and the responsibility of the physician is supported by the responsibility of the partner and the company. Supporting this responsibility shows that participatory performance is not ineffective in adjustment the challenges unrelated to the physician performance.
