Contemplation on the Parameters of the Quranic Jurisprudence in the View of Dr. Sadeqi Tehrani
There are different approaches to referring to the Holy Quran as a source of Islamic law. In contrast to two practical approach of “non-referring to the Holy Quran” and the approach of “minimal referring to it” which are noticed by traditionalists and fundamentalists respectively, the approach of “maximum referring to the Holy Quran” is observed among a number of contemporary scholars like Dr. Sadeqi Tehrani. His deductive jurisprudence is regarded by him as a Quranic jurisprudence the parameters of which are reviewed in this article. These parameters include: Using the Quranic literature, the preference of citing the Holy Quran, invalidity of the tradition against the Holy Quran, invalidity of consensus and fame against the Holy Quran, and invalidity of logical proofs against the Holy Quran, every one of which has been studied based on jurisprudential adaptations. The first and the second parameters are acceptable. The third and the fourth parameters are acceptable as a particle requirement and the fifth one is not acceptable.
